'<D'b .:\'<' <br />....v" ,'\ '\. -<":REFERENCE: <br />.( )0 " 0~ <br />rS:} : ~Ci >0 <br />'V '"4" ~u <br />.,~~,~(), . <br />v.~~~~c.,C'<>WHEREAS, the Constitution and By-Laws of the Ute Mountain <br />~~~,~~&~ Tribe, approved June 6, 1940 and subsequently amended, <br />provides in Article III that the governing body of the Ute <br />Mountain Tribe is the Ute Mountain Tribal Council and sets <br />forth in Article V the powers of the Tribal Council exercised <br />in this Resolution; and <br /> <br />~ RESOLUTION ~ <br />UTE MOUNTAIN TRIBAL COUNC~ <br />TOWAOC MUNICIPAL PIPELINE CONSTRUCTION <br /> <br />CONTRACT <br /> <br />WHEREAS, the Ute Mountain Tribal Council <br />improving the social and economic well-being <br />the Ute Mountain Tribe; and <br /> <br />is committed to <br />of the members of <br /> <br />. WHEREAS , the Ute Mountain Tribal Council entered into the <br />, Colorado Ute Tribe's Settlement Agreement on December 10, 1986 <br />in order to resolve Tribal Water ,Rights Claims amicably with <br />the State of Colorado and the neighboring communities adjacent <br />to the reservation; and <br /> <br />WHEREAS, the Ute Mountain Tribal Council is ' committed to <br />providing a safe and reliable municipal water supply to the <br />reservation residents; and ' <br /> <br />WHEREAS, the State of Colorado has agreed to provide a <br />pipeline and related storage and distribution systems (with <br />the exception of the Mancos line)-for the Ute Mountain Tribe <br />as required by the Settlement Agreement; and <br /> <br />WHEREAS, the Ute Mountain Tribal Council is committed to <br />having the Mancos line included as a part of'this project; and <br /> <br />WHEREAS, the Ute Mountain Tribal Council is willing to <br />authorize the approval of the construction contract for the <br />Towaoc Municlpal Project under the following conditions: <br /> <br />1. The State of Colorado will make every effort possible to <br />include the Mancos line as a part of the Towaoc Municipal <br />Project. <br /> <br />2. The State of Colorado will attempt to secure additional <br />funding for the construction of the Mancos, line as per <br />the terms and conditions of the Colorado Ute Tribes' <br />Settlement Agreement. <br /> <br />3.
