<br />DATE <br /> <br />OctObe7. 1988 <br /> <br />'OLUTION NO. <br /> <br />3460A <br /> <br />RESOLUTION <br />UTE MOUNTAIN TRIBAL COUNCIL <br />REFERENCE: TOWAOC MUNICIPAL PIPELINE PROJECT RIGHT-OF-WAY <br /> <br />WHEREAS, the constitution and By-Laws of the Ute Mountain <br />Tribe, approved June 6, 1940 and subsequently amended, <br />provides in Article III that the governing body of the Ute <br />Mountain Tribe is the Ute Mountain Tribal Council and sets <br />forth in Article V the powers of the Tribal Council exercised <br />in this Resolution; and <br /> <br />WHEREAS, the Ute Mountain Tribal Council <br />improving the social and economic well-being <br />the Ute Mountain Tribe; and <br /> <br />is committed to <br />of the members of <br /> <br />WHEREAS, the Ute Mountain Tribal Council is committed to <br />providing a safe and reliable municipal water supply to the <br />residents of Towaoc; and <br /> <br />WHEREAS, the Ute Mountain Tribal Council has entered into the <br />"COLORADO UTE TRIBES' WATER RIGHTS SETTLEMENT AGREEMENT" on <br />December 10, 1986; and <br /> <br />WHEREAS, the <br />requires that <br />municipal and <br />Colorado; and <br /> <br />"Colorado Ute Tribes' Settlement Agreement" <br />the State of colorado fund the construction of a <br />industrial pipeline to the community of Towaoc, <br /> <br />WHEREAS, the State of Colorado has requested a right-of-way <br />along the portion of pipeline route on the Ute Mountain <br />Reservation in order to ini tiate construction acti vi ties on <br />the pipeline as identified on Attachemnt A (Right-of-Way <br />Application and Map); and <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the Ute Mountain Tribal <br />Council approves the attached BIA Right-of-Way Application for <br />the Towaoc Municipal Pipeline Project as Attachment A. <br /> <br />BE IT FURTHER RESOLVED, that upon completion of the pipeline <br />and certification as to the operability of the line and <br />related improvements in accordance with generally accepted <br />industry standards by the State of Colroado and the <br />construction contractor, that title to the right-Of-way will <br />automatically be transferred to the Ute Mountain Tribe. <br /> <br />BE IT FINALLY RESOLVED, that the Chairman of the Ute Mountain <br />Tribal Council is authorized to sign the Resolution and is <br />further authorized to take such action as may be necessary to <br />carry out the intent of this Resolution, <br />
