Require all Sub-contractors to indemnify the State and <br />the Contractor against all liability and loss, and against all <br />claims and actions based upon or arising out of damage or <br />injury, includin~ death, to persons or property caused by or <br />sustained in cOnl)ection with the performance of any subcontract <br />or by conditions created thereby, or based upon any violi,ition <br />of any statute, (,rdinance, or regulation, and the defense of <br />any such claims c'r actions. <br /> <br />4. Require all Sub-contractors to maintain liability <br />insurance in at least the following amounts: <br /> <br />a. Fox any injury to one person in any single <br />occurrEnce, the sum of One Hundred Fifty ThousClnd <br />Dollars ($150,000). <br /> <br />b. Fox any injury to two or more persons in any <br />single occurrence, the sum of Four Bundred Thousand <br />Dollar. ($400,000). <br /> <br />Said liability insurance shall name the Contractor <br />and the State as co-insureds. No payments shall be made under <br />this contract unless a copy of a certificate of said liability <br />insurance has beE,n filed with the Colorado Water Conservation <br />Board. <br /> <br />-~ <br />~u <br /> <br />5. Convey elr cause title to be conveyed by deed or <br />other proper con'\"eyance to the Colorado Water Conservation <br />Board, Department of Natural Resources, State of Colorado, the <br />following portions of the proposed project facilities within <br />thirty (30) days of their completion: <br /> <br />Ja. A 6-inch ductile iron pipe, about~011inear <br />feet, with all appurtenances begin- ng at Brook <br />Forest Road (station 44+36.48) and along Forest <br />Estates Road to the intersection with Saint <br />Moritz Drive (station 14+86.73), all as shown in <br />the appended vicinity map. <br /> <br />b. An undivided fifty percent (50%) interest in the <br />proposed 37+ foot dam, 25~ acre-foot reservoir <br />and the land on which they will be located. Dam, <br />reservoir, and land are as shown in the appended <br />vicinity map. <br /> <br />6~ Permit periodic inspection of construction by <br />authorized representatives of the State during and after <br />construction. <br /> <br />7. Withou~ expense to the State, manage, operate, and <br />maintain the. project system continuously in an efficient and <br />economical mannej~, and assume all legal liability for such <br />management, open.ttion, and maintenance. The Contractor shall <br />maintain general liability insurance covering its management, <br />operation, and mc.intenance of the project system until it has <br />completed purchalE.e of the project system from the State in at <br />least the fOllowi,ng amounts: <br /> <br />a.
