<br />CONTRACTOR: BROOK FOREST WATER DISTRICT <br />Contract No. C153349 <br /> <br />Agency Name: Water Conservation Board <br />Agency Number PDA <br />Routing Number: 03 PDA (j 00 C( r <br /> <br />Con t r act Arne n d men t No. 1 <br /> <br />THIS AMENDMENT, made this November 1, 2002, by and between the State of <br />Colorado for the use and benefit of the Department of Natural Resources, Colorado Water <br />Conservation Board, hereinafter referred to as the CWCB and/or STATE, and the Brook <br />Forest Water District, P,O, Box 3728, Evergreen, CO 80437, hereinafter referred to as the <br />CONTRACTOR. <br /> <br />Factual Recitals <br /> <br />A. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise <br />made available for payment in Contract Encumbrance Number C 153349. <br /> <br />B. Required approval, clearance, and coordination has been accomplished from and with <br />appropriate agencies, <br /> <br />C, The CWCS and the CONTRACTOR entered into a contract dated July 15, 1981, Contract <br />Encumbrance Number C153349, hereinafter referred to as ORIGINAL CONTRACT, <br />incorporated herein by reference, wherein the CWCB agreed to loan money in the total <br />amount of $164,500, and the CONTRACTOR agreed to repay the loan in accordance with <br />the terms of the Original Contract. <br /> <br />D. As collateral for the loan, the CONTRACTOR conveyed fee title to certain real property to <br />the CWCB by a warranty deed dated January 6, 1983. <br /> <br />E. By its letter dated September 4, 2002, the CONTRACTOR requested the CWCS to convey <br />fee title to the collateral back to the CONTRACTOR in exchange for a deed of trust executed <br />by the CONTRACTOR conveying a security interest in the collateral to the CWCS, <br /> <br />F, The current practice of the CWCS is to take a security interest in the collateral through a <br />deed of trust. <br /> <br />G. The CWCS and the Contractor agree to amend this contract to exchange the deed for a <br />deed of trust. <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. Consideration for this Amendment to the ORIGINAL CONTRACT consists of the payments <br />that shall be made pursuant to this Amendment and the ORIGINAL CONT~CT, as <br />amended, and the promises and agreements herein set forth, <br /> <br />Page 1 of 3 <br />
