Box 187 <br />Holly, Colorado 81047 <br /> <br />Dear Young: <br /> <br />Reference is made to your letter dated October 21, 1996 <br />regarding the proposed reconstruction of a headgate and diversion <br />dam located on the Arkansas River near Granada, Prowers County, <br />Colorado. (Action No. 1996 30253) <br /> <br />We have reviewed your proposed project. The Clean Water Act <br />and implementing regulations at 33 CFR 323.4(a) describe several <br />exemptions for discharges of dredged or fill materials into <br />waters of the United States. Your reconstruction of a headgate <br />and diversion dam to Buffalo Canal is exempt from regulation <br />under exemption No. 3 for construction or maintenance of farm or <br />stock ponds or irrigation ditches. A Department of the Army <br />permit will not be required.
