<br />. <br /> <br />Feasibility of the Repair <br />of the <br />Buffalo Mutual Irrigation Company Head Gate <br />and Diversion Dam <br /> <br />1. Proiect Soonsor: <br /> <br />The Buffalo Mutual Inigation Company (BMIC) is a Colorado Mutual Ditch Company <br />and a Non-profit Corporation, Articles of Incorporation and Bylaws are included in <br />Appendix A. The average diversion by the ditch from 1940 to 1985 was 17560 acre-feet <br />according to the Colorado Water Budget published in 1990 by Boyle Engineering for the <br />office of the State Engineer. The Buffalo has 4690 shares of water owned by 39 share <br />holders. The average yield per share from 1940 to 1985 was 3.74 acre-feet. Current <br />officers are Edward L. Bates, chairman; Rodney Thompson, secretaIy; and Robert Parker, <br />vice-chairman. The three most recent financial statements are listed in Appendix F. <br /> <br />. <br /> <br />Water Rights: <br />The water rights owned by the members of the Buffalo canal consist of the original decree <br />on the Arkansas River plus five additional rights on the runoff of four draws and Buffalo <br />Creek. <br /> <br />The original decree for the Buffalo on the Arkansas river was rendered by the District <br />Court of the 3rd Judicial District on February 28, 1895 for a priority of date January 29, <br />1885, for 67.5 cubic feet per second. The dc:cree calls for the inigation system to supply <br />1 Yz acre feet of water per acre dwing the period from April 1 to September 30, and Yz <br />acre-foot per acre from October 1 to March 31. On December 12, 1949, the 3rd Judicial <br />District Court ordered in a civil suit that the owners of the water rights of the Buffalo Canal <br />fonn a Mutual irrigation company under articles of incorporation.
