<br />". <br />~Jr.. <br /> <br />CC~:~':i' rl ~~fl::,':n '::~'.~ of C.:. <br /> <br />THIS <br /> <br />EXHIBIT C <br />AGENCY 34-'~" ~!- J <br />WATER LINE EXTENSION AGREEMENT ' ";' , <br />CONTROL II <br /> <br />(l' jj !)JA[)(I\{ '1 <br />AGREEMENT made and entered into ~y <br /> <br />of April, 1982, by and between the KELTON HEIGHTS WATER <br /> <br /> <br />AND SANITATION DISTRICT, a quasi-municipal corporation, <br /> <br /> <br />operating and existing under and by virtue of the laws of the <br /> <br />State of Colorado, hereinafter referred to as "District", and <br /> <br />the SOVTH SHERIDAN BAPTIST CHURCH, hereinafter called ItCus- <br /> <br />" <br /> <br />tomer." <br /> <br />WITNESSETH: <br /> <br />" <br /> <br />WHEREAS, Customer <br /> <br />is the owner of property within <br /> <br />the boundaries of the District which is proposed to be served <br /> <br />by facilities constructed pursuant to this Agreement; and <br /> <br />WHEREAS, Customer wishes to have water facilities <br /> <br />constructed to serve said property and to connect the facili- <br /> <br />ties to the water system of the District; and <br /> <br />WHEREAS, Customer' 6 unique demands :for water <br /> <br />pressure for fire flow require the District to oversize <br /> <br />adjacent water main lines and to make an additional connec- <br /> <br />tien to the distribution conduit in South Sheridan Boulevard; <br /> <br />and <br /> <br />WHEREAS, the District has obtain~d a loan from the <br /> <br />col)7rado Water Conservation Board to upgrade the water sys~em <br />of/the District, and <br /> <br />-/ <br /> <br />WHEREAS, District is not required to enlarge or <br /> <br />extend its facilities beyond those necessary to provide <br /> <br />standard service to residential and commercial properties <br /> <br />currently existing and all such enlargements or extensions <br /> <br /> <br />are undertaken in the discretion of the District in exer- <br /> <br />cising its proprietary function and in the interest of the <br /> <br />public health, safety and welfare; <br /> <br />NOW, THEREFORE,. in consideration of the premises, <br /> <br /> <br />thp. mutual advantages accruing to the parties herein and in <br /> <br /> <br />consideration of the performance of the covenants agreed to <br /> <br />.. <br /> <br />" <br />
