<br />. <br /> <br />. <br /> <br />CHAPTER II <br /> <br />THE PARADOX VALLEY CANAL AND RESERVOIR COMPANY <br /> <br />History <br /> <br />The Articles of Incorporation for the Paradox Valley Canal and Reservoir <br />Company was filed in the office of the Secretary of the State on the 7th day <br />of February, 1949. The Paradox Valley Canal and Reservoir Company has oper- <br />ated as a non-profit corporation since that time. The water used for irri- <br />gation purposes in the Paradox Valley was originally filed on in the State <br />of Utah on January 19, 1893 by the Stevens Land and Cattle Company and a later <br />filing by James F. Kyle on a ditch on November 18, 1907. Both filings are on <br />record in the Montrose County Courthouse and refer to the Buckeye Reservoir. <br />However; plans for the Buckeye Reservoir were no~ submitted to the State Engi- <br />neer of Colorado until 1909 by the Paradox Valley Land and Development Company., <br />The Paradox Valley Land and Development Company was in business for a short <br />time before bankruptcy when a private party took the system over and the West <br />End Irrigation Company was formed. When the Paradox Valley Canal and Reservoir <br />Company was formed in 1949 the West End Irrigation Company was dissolved. No <br />records, except for water filings, of previous water companies in the Paradox <br />Valley are known to exist and most of the information has corne from old-timers <br />living in the area. <br /> <br />Prior to July 1, 1975 all water rights for the Paradox Valley Canal and <br />Reservoir Comp'any and its predecessors were filed for and obtained in the State <br />of Utah. On July 1, 1975 the Paradox Valley Canal and Reservoir Company <br />applied for and received an absolute decree for the storage of 3,000 acre feet <br />of water and the use of 85.0 cubic feet of water per second of time from the <br />State of Colorado. The original water decrees from the State of Utah date back <br />to June 1, 1892, said water decrees allowed the importation of water from Utah <br />to the irrigated lands in Colorado. The 1975 water decree in the State of <br />Colorado bears a priority date of January 14, 1922. <br /> <br />Laws Under Which Organized <br /> <br />The Paradox Valley Canal and Reservoir Company is organized and incorporated in <br />the State of Colorado as a non-profit mutual stock company allowing only stock <br />to be owned by those owning land under and irrigated through the Paradox Valley <br />Canal and Reservoir system. <br /> <br />A copy of the Articles of Incorporation, By-Laws, and Water Rights as recog- <br />nized by the State of Colorado are contained in the Appendix of this report. <br />The By-Laws and Articles of Incorporation cover the annual meetings, the elec- <br />tions, duties of the Board and general information and are open to various <br />interpretations of other actions. <br /> <br />Power and Authority of the Organization <br /> <br />The Paradox Valley Canal and Reservoir Company does not have the right of emi- <br />nent domain nor can they levy a tax.
