Unit 77-77-777, <br /> <br />.WHEREAS. rt4uired apllfI)VlIl. c:ltarnm:t and coordination has; betn accomplished hom and with appropriarl! <br />a8entle5; and <br /> <br />WHEREAS. a contract was entered into on June 22. 1988. <br />Contract Encumbrance Number C-1S3514 (the Original Contract). <br />between the State and the Contractor: and <br /> <br />WHEREAS. a contract amendment was entered into on November <br />4. 1988, Contract Encumbrance Number C-153514 (Contract <br />Amendment *l)~ between the State and the Contractor: and <br /> <br />WHEREAS. construction of the project has now been completed <br />at an amount less than what was anticipated when Contract <br />Amendment #1 was written: and <br /> <br />WHEREAS. it is now necessary to reduce the money made <br />available to the amount of money necessary to complete <br />construction. <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />1. <br /> <br />This Contract Amendment #2 is a supplement to Contract <br />~mendment #1 (Appendix A). which is by this reference ~ <br />incorporated and made a part hereof: and all the terms. <br />conditions. and provisions thereof. unless specifically <br />modified herein. are to apply to this contract amendment as <br />though they were expressly rewritten. incorporated. and <br />included herein. <br /> <br />2. The only modifications. alterations, or changes in Contract <br />Amendment #1 shall be that Attachment B and paragraphs B.11. <br />0.1.. and J. shall be deleted and in their place Appendix B <br />and the following paragraphs shall be inserted: <br /> <br />B. The Contractor agrees that it shall: <br /> <br />11. Repay to the State the total principal sum of Eight <br />Hundred Twenty-Eight Thousand Four Hundred One Dollars <br />($828.401), which includes the project loan amount and <br />the Sixty-thousand-Dollar ($60.000) feasibility report <br />amount. together with interest at the tate of five <br />percent (5\) per annum, said repayment to be made in <br />constant annual installments of Forty-Eight Thousand Two <br />Hundred Seventy-Seven Dollars and Sixty-Nine Cents <br />($48.277.69) each. for forty (40) years. as shown in <br />Appendix B. attached hereto and .incorporated by reference <br />herein. which first installment shall be due and payable <br />on December 1. 1989. and yearly thereafter until the <br />entire principal sum shall have been paid.
