WHEREAS. rCljuired approval, clearance and coordinalion has been accomplished from and wilh appropriate
agencies: and

~HEREAS, the State and the Contractor did, on July 1,
1983, enter into a contract for State participation in the
enlargement and improvement of the Hertha Reservoir for the
ditch company members in Larimer County, which contract is
attached hereto as Exhibit A and is hereby incorporated herein;
and

WHEREAS, the construction bid received, together with the
change orders necessary to complete the project, exceeded the
engineers' estimatej and

WHEREAS, douse Bill 1102 (1983 Session), which authorized
the Hertha Reservoir also provided that the Board could expend
on the project specified the amounts of money listed plus or
minus such amounts, if any, as may be justified by reason of
ordinary fluctuation in construction costs as indicated by the
en~ineeri~g cost indices applicable to the types of
construction involved for such projects or as may be justified
by reason of changes made in the plans and specifications of
the project if those changes are required by finalized
engineering drawings and specifications; and

WHEREAS, the State is satisfied that up to four percent
(4%) of increase in construction costs has occurred from the
ti!!\e the project was authorized until the project was bidj and

WHEREAS, by reason of changes made in the plans and
specifications, the project cost has increased from the amounts
estimated by the engineers at the feasibility study level; and

NOW THEREFORE, in consideration of the mutual and dependent
convenants herein contained, it is agreed by the parties hereto
as follows:

1. The terms and provisions of paragraphs A12, C1 and I
of that certain contract dated July 1, 1983, attached hereto as
Exhibit A and incorporated herein by reference, shall no longer
be effective. All other terms and provisions of that certain
contract dated July 1, 1983, shall remain in full force
and effect.

2. Paragraphs A12, C1, and I are amended to read as
follows:
