It is my further opinion: <br /> <br />1, That Floyd Larkin may sign the Contract, upon approval <br />of the Board, as the duly elected Mayor of the Town and that the <br />said Contract has been validly approved by vote of the Board ( a <br />copy of the minutes of the meeting approving the contract are <br />attached) <br /> <br />2. The governing body of the entity has the authority to <br />enter into this contract without a vote of its residents as this <br />contract comes within the "water supply exception" of the <br />Colorado constitution, Article XI, Section 1, ( a copy of C.R,S, <br />31-35-402 is attached) <br /> <br />3. There are no provisions of state or local law that <br />prevent this contract from binding the Town, if entered into <br />by the State. <br /> <br /> <br />I <br /> <br />"" <br />
