<br />CONTRACT
<br />
<br />THIS CONTRACT, made (/lis 15th day of December 197..2, by and between the
<br />Slate of Colorado for the use and benefit of tile Department of" Natural Resources
<br />(Colorado Water co~servation Board)
<br />hereinafter referred 10 as, the Slate, and "2 Beaver Park Water. Inc., P.O. Box 286,
<br />Penrose. Colorado 81240
<br />hereinafter referred to as the contractor,
<br />
<br />WHEREAS, authority exists in the Law and Funds have l.een hudgeteJ. appropriated and otl1erwise made
<br />available and a suHicient unencumbered balance thereof remains available (or payment in Fund Number 4008 ,
<br />G/l Account Number 5603;;, Contract Encumbrance Number (Z' /<; .l~ ; and
<br />
<br />WHEREAS. required approval, clearance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />
<br />WHEREAS, '~ursuant to Title 37, Article 60, Colorado Revised statutes
<br />1973, as amended, t~e state, through the colotado Water Conservation
<br />Board, may construct water resource projects ond make the waters avail-
<br />able therefrom to t~e residents of the state Of Colorado upon conditions
<br />to be determined by the Colorado Water Conser~ation Board; and
<br />
<br />WHEREAS, the contractor is a duly constit0ted incorporated entity
<br />of the state of Colorado and wishes to refinance its irrigation system,
<br />hereinafter called the project, for the Beave~ Park community in
<br />Fremont county, colorado. at an estimated cost of One Million Five
<br />Hundreu Thousand Dollars ($1,500,000); and
<br />
<br />WHEREAS. the st~te, through the COlorado ~ater Conservation Board,
<br />has agreed to refin~nce said project and to sell the same to the Con-
<br />tractor upon mutualJy agreeable terms and conditions, subject to the
<br />approval of apPropr~ations for that purpose by the Colorado General
<br />Assembly and the GovernOr of the state of COlorado; and
<br />
<br />WHEREAS, pursuaOt to Senate Bill No. 537, Fifty-Third General
<br />Asselnbly of the sta~e of Colorado, duly enacted by the COlorado General
<br />Assembly and approved by the Governor of the state of Colorado, there
<br />was appropriated to the ColoradO Water Conservation Board the sum of
<br />One Million Five Hu~dred Thousand Dollars ($1,500,000) fOr refinancing
<br />of the Beaver Park rroject;
<br />
<br />NOW, THEREFORE, in consideration of the mutual and dependent
<br />covenants herein co~tained, it is agreed by the parties hereto as
<br />follows:
<br />
<br />A. The Contractor agrees that it will:
<br />
<br />1. Cause refinancing of said project within one (1) year of the
<br />date of this contract. No payments will be made under this contract
<br />until article A.2. of this contract has been complied with.
<br />
<br />2. Conveyor cause title to be conveyed by deed or other prOper
<br />conveyance to the colorado water Conservation Board, Department of
<br />Natural Resources, state of Colorado, the following water rights:
