Allottee shall automatically lose a portion of Its allotted <br />capacity In the Pipeline pursuant to the procedures set out In paragraph <br />8.b.l. below. and the Allottee shall have no further obligation to pay such <br />sums or additional future sums related to the lost portions of Its allotted <br />capacity . <br /> <br />lv, The SWSP Enterprise shall deposit all funds provided by the Allottee <br />pursuant to paragraphs 6.b.. 6.b.i.. 6.b.lI. and 6.b.lII. above In an <br />Interest beartng account and shall pay the Interest eanled on said funds <br />to the Allottee on a qu~erly basis. <br /> <br />v. Allottee agrees to make payment of. pursuant to the procedures set out <br />In paragraph 8.a. below and subject to paragraph 8.b. below. Its share of <br />annual charges and costs Incurred by the SWSP Enterprise In the <br />administration. OperatiOn. maintenance. repaJr. and replacement of the <br />Pipeline and such other annual costs as may arise from and be <br />attributable to the operation of the Pipeline. <br /> <br />vi. Allottee agrees to make payment of. pursuant to the procedures set out <br />In paragraph a.a. below and subject to paragraph a.b. below. its share of <br />such an annual amount as the Board shall determine to be necessary to <br />establish and maintain an operating and maintenance reselVe fund <br />equal to eighteen months operating and maintenance charges and costs. <br /> <br />c. The payments descrtbed In thiil paragraph 6 and In paragraph a below are full <br />payment for all water delivery services to be provided to Allottee under this <br />Contract. No other charge. fee. tax. or levy for the Pipeline or the use thereof. <br />shall be made to Allottee or its citizens. directly or Indirectly by SWSP <br />Enterprise; except for any fees, charges or assessments charged or levied by the <br />District or Subdistrict In connection with allotment contracts for District water <br />or Subdistrict water or inclusion of the Allottee or Its land area within the <br />boundaries of the District or Subdistrict. or taxes charged or levied by the <br />District or Subdistrict on lands Included within the District or Subdistrict. <br /> <br />d. All money paid to the SWSP Enterprise by the Allottee under this Contract shall <br />be kept In separate accounts from all other accounts of the SWSP EnterpriSe or <br />the District and shall be used only for Pipeline purposes as specified In this <br />Contract. <br /> <br />7, Estimated Demand and Deliverv Schedule, Commencing In the year In which <br />the Pipeline becomes operational and on or before December I of each year thereafter. Allottee <br />shall provide the SWSP Enterprise with an estimated demand and delivery schedule for the <br />use of its capacity. not to exceed the amount allotted herein. for the follOwing calendar year. <br />This schedule shall contain the time and quantities of water which Allottee estimates It shall <br />require to be transmitted by the Pipeline. This schedule may be modified by the Allottee from <br />time to time as the need warrants. In Its sole discretion. within the physical capabilities of the <br />Pipeline. <br /> <br />10 <br />
