<br />I. This contract shall not be deemed valid until il shall have been approved by the Controller of the State of
<br />Colorado or liuch as:;istaul as he may dl::;iguate. This I)rovisioll is applicable 10 any contract iuvolviu!; the payment of

<br />FUND AVAILABILITY
<br />
<br />2. Financial obligations of the Stale payable afler the current fJ:>Cal year are contingenl upon funds for that
<br />purpose being appropriafed, budgeted and otherwise made available,
<br />
<br />BOND REQUIREMENT
<br />
<br />3. If this contract involves the paymenl of more than ten thousand dollars for the construction, erection, repair,
<br />maintenance, or improvement of any building, road. bridge, viaduct, tunnel, excavation or other public work for this
<br />Stale, the contractor shall, before entering upol1 the performance of any such work included in this contract, duly
<br />execute and deliver to and file wilh the official whose signature appears below for the State, a good .md suffident
<br />bond or other acceptable surety to be approved by said official in a penal sum not less than one-half of the total
<br />amounl payable by the terms of this contract, Such bond shall be duly executed by a qualified corporate surety,
<br />conditioned for the due and faithful perfonnance of the contract, and in addition, shall provide thai if the contractor or
<br />his subcontractors fail 10 duly pay (or any labor, materials, learn hire, sustenance, provisions, provender or other
<br />supplies used or consumed by such contracCor or his subcontractor in peformance of the work contracted to be done,
<br />the surety will pay the same in an amount nOI exceeding the sum specified in the bond, together with interest at the
<br />ralC of eighl per cent per annum. Unless such bond, when so required, is eXeCuted, delivered and filed, no claim in
<br />favor of lhe contraclor arising under this contract shall be audited, allowed or paid. A certified or cashier's check or a
<br />bank money order made payable 10 the Treasurer of the State of Colorado may be s.cceplcd in Jeiu of a bond,
<br />
<br />MINIMUM WAGE
<br />
<br />4, Except as otherwise jJrovided by I-,w, if this contract provides for Ih~ payment uf mure thall five thuusand
<br />dollars and requires or involves the employment of laborers or meclumics in Ihe construction, alteration or repair of
<br />any building or other public work, (excepl highways, highway bridges, underpasses and highway slructures of all
<br />kinds) within the geographicallimils of the State, Ihe rote of wage for all laborers and mechanics employed by the
<br />coutrolctor ur any subcontructor on the building or public work covered by Ihis contract shull be not less than the
<br />prevailing rate of wages for work of a similar nature in Ihe city', town, village or other civil subdivision of the Stale in
<br />whicb the building or other public work is located. Disputes respecting prevailing rates will be re.solved as provided in
<br />8-16-101. CRS 1973, as amended.
<br />

<br />S. The contraclor agrees 10 comply wilh the letter and spirit of the Colorado Antidiscrimination Acl of 19S7,
<br />as amended, and other applicable law respecting discrimination and unfair employment practicl,$ (24-34-301. CRS
<br />1973, as amended), and as required by Execulive Order, Equal Opportunity and Affinnative Action, dated April 16,

<br />During the perfonnance of Ihis contracl, the contractor agrees as follows:
<br />(I) The conlractor will not discriminale against any employee or applicant for employment because of
<br />....oIce, creed, color, national origin, sex, marilal status, religion, ancestry, mental or physkal handicap, or age.
<br />The contractor will lake affirmative action to insure that applicants are employed, and Ihat employees are
<br />treated durillg employmenl, withoul regard 10 Ihe above mentioned characteristics. Such actiol1 shall include,
<br />but not be limited to the following: employment, upgrading, demotion, or transfer, recruitmenl or
<br />recruHment advertisings; lay-offs or tenninafions; roltes of payor other fonns of compensation; and selection
<br />for lroining, including apprenticeship. The conlractor agrees Co post in conspicuous places, available to
<br />employees and applicanls for employmenl, nolices to be provided by the contracting officer setting forth
<br />provisions of this non-discrimination clause.
<br />(2) The conlractor will, in all solicitations or advertisements for employees placed by or on behalf of the
<br />conlraclor, state that aU qualified applicanls will receive consideration for employment without regard to
<br />race, creed, color, nalional origin, sex, marital status, religion, ancestry, mental or physical handicap, or age.
<br />(3) The contractor will send to each labor union or representative of workers with which he has coUective
<br />bargaining agreement or other conlract or understanding, nOlice to be provided by the conlracting officer,
<br />advising the labor union or workers' represenlative of the contractor's commiltment under the E~eculive
<br />Order, Equal Opportunity and Affinnative Action, dated April 16, 1915, and of the rules, regulations., and
<br />relevant Orders of the Governor.
<br />(4) The conlractor and labor unions w1t1 furnish all informalion and reports required by Executive Order,
<br />EtjuaJ Opportunity and Affinnative Action of April 16, 1975, and by Ihe rules, regulaliol1s and Orders of the
<br />Governor, or pursuant thereto, and will permit access to his books, records, and accounts by the contracting
<br />agency and the office of the Governor or his designee for purposes of investigatioll to ascertain compliance
<br />wilh such rules, regulations and orders.
