' '. <br /> <br />" <br />'\ <br />" \\ <br /> <br />MEETING CALLED TO ORDER <br /> <br />Mayor John Host called the regular meeting of the Board of Trustees to <br />order at 7:33 P,M. <br />ROLL CALL <br /> <br />Those answering roll call were Mayor Host and Trustees Bair, Darien, Carney, <br />Klenck and Terwilliger. Also present were town attorney Peter Milwid, town <br />engineer Dean Gordon, administrator L'Estrange, police chief Isaacs and <br />clerk Coble. . <br />MINUTES OF PREVIOUS MEETING <br /> <br />Trustee Grant arrived. Trustee Carney moved to approve the minutes of <br />February 22, 1984 as written. Second by Terwilliger; all ayes. <br /> <br />EXECUTIVE SESSION <br /> <br />Trustee Carney moved to go i~to executive session to discuss an attorney- <br />client matter at 7:35 P.M. Second by Darien; all ayes. <br /> <br />At 8:05 Trustee Darien moved to close the executive session and return to <br />regular session. Second by Carney; all ayes. <br /> <br />WOODWARD FROZEN WATER LINE <br /> <br />Mayor Host asked Sandra Woodward if she would be willing to tuble the matter <br />for two weeks. He explained that her letter and request for the town to <br />pay repair bills on her water service line were different than the Board <br />discussed at their last meeting and that the Board would like the town <br />administrator and engineer to get together with her before any final decision <br />is reached. Woodward said that .would be fine. Trustee Grant moved to <br />continue the matter to the next regular meeting. Second by Terwilliger; all <br />ayes. A copy of Woodward's letter is attached hereto. <br />HYDE PARK AMENDED PUD MASTER PLAN AND PRELIMINARY PLAN AND PLAT FOR PHASE I <br /> <br />L'Estrange said that he received two communications since the Board's <br />packets were sent out for the meeting on the Hyde Park project, a letter fro!:"! <br />the Colorado Water Conservation Board which he summarized in a memo and <br />a letter from the Highway Dept. Copies of the memo and lIighway Dept. letter <br />were handed out to the .Board, and copies are attached hereto. <br /> <br />Milwid recalled that the Board discussed all the conditions of approval <br />for the applications recommended by P&Z at their February 22, 1984 meeting. <br />He said an additional consideration tonight would be the CWCB letter. Brian <br />Hyde cites a statute in that letter for eWCB's authority which Milwid <br />thought is incorrect. He. said perhaps L'Estrange's suggestion that it is <br />a technical matter that can be dealt with as a condition. Attorney Dan <br />Kerst said that he could not find that Hyde's statute citation was applicable <br />either. He then introduced Claycomb Engineering's senior engineer, Elmer <br />Claycomb. Claycomb said that 10 years ago he was one of the first consultants <br />qualified by the Army Corps of Engineers to perform flood insurance studies. <br />Since then he hae done many for the CWCB, the Corps and others. He said the <br />statute cited by Hyde refers to a model ordinance recently adopted by the <br />State; the town uses an older model which says that for property not <br />designated in the flood plain study for the town (Chapter 33 of the Town <br />Code) the administrator shall review and use any data available from the <br />federal government, state, ~tc. He concluded that CWeB approval is not <br />required legally. He said he believed the Town has the right to deal with <br />the Hyde property if they are comfortable that the data has been properly <br />analysed and is not bound to the CWCB. Claycomb went on to say that he did <br />the floodplain data for Basalt. At that time, the Hyde property was not in <br />the town. However, data was collected.on the Hyde property and others south <br />of the river in order to make accurate findings for the Basalt side. <br /> <br />L1Estrange said he had written cwcn requesting them to look at and <br />designate the floodplain study for Hyde Park done by Claycomb. One of the <br />people he talked with at CWCB said he felt Claycomb's work has the <br />necessary validity required for CWCB to confirm the. study. Kerst asked <br />that the record reflect that. Claycomb's Larry Thompson has had extensive <br /> <br />~ <br />
