Un~t 77-77-7 7, <br />WHEREAS, required approval. cle:mmce and coordination has been accomplished from and with appropriate <br />3gencie5: and <br /> <br />." ~~WHEREAS. pursuant to the provisions of section <br />37-60-ll9.Colorado Revised Statutes. as amended. the State is <br />authorized to construct certain water projects for the benefit <br />of the people of the State of Colorado: and <br /> <br />WHEREAS. the Town of Oak Creek has made application to the <br />State for the improvement of its existing facility. such <br />improvement of the facility is hereinafter sometimes referred <br />to as the project; and <br /> <br />WHEREAS. the Contractor is a Town within the State of <br />Colorado; <br /> <br />NOW THEREFORE. it is hereby agreed that: <br /> <br />1. The Contractor shall have a feasibility report prepared <br />and directed to the problem of stUdying and improving the <br />spillway facilities of the Sheriff Reservoir. in accordance <br />with a proposal for a project feasibility report prepared by <br />the conSUlting engineering firm of Geotechnical Engineers Inc. <br />the Consultant) and approved by the State. received September <br />10. 19S6, which proposal is attached hereto as Exhibit A and <br />made a part of this contract. <br /> <br />~.. 2. F.ift.e.en (15)_coI>iesof the final report called for in <br />this contcacti;haH'''be .furnished to the State not later than <br />Novembe~_ 30. 1986. unless such time is extended by mutual <br />agreement of the parties hereto in writing. <br /> <br />3. As compensation for the services of the Contractor. the <br />State shall pay to the Contractor the sum of Eighteen Thousand <br />Dollars ($16,000) in the manner following: <br /> <br />a. sixty percent (60%). to wit. Ten Thousand Eight <br />Hundred Dollars ($10,600) of the total amount due in <br />two (2) monthly installments of Five Thousand Four <br />Hundred Dollars ($5.400) each, commencing on October <br />l5. 1986. <br /> <br />b. The remaining forty percent (40%). to wit. Seven <br />Thousand Two Hundred Dollars ($7.200) within forty <br />(40) days following receipt and acceptance of the <br />written report specified in paragraph 2 of this <br />contract. <br /> <br />4.
