The <br /> <br /> <br />results of this review will be reported to the <br />State by the Contractor in a letter report, said <br />report to be provided to the State not later than <br />August 1, 1986. The Contractor need not implement <br />any changes identified by this review as part of <br />this task. <br /> <br />d. Negotiate with Reclamation a contract(s) lias to <br />forml' which, when executed, will obligate the <br />Contractor to acquire the necessary real property <br />interests in the laterals under its canal system <br />and to operate, maintain, and annually inspect the <br />improved laterals, said contract(s) lias to formll <br />to be sUbject to final agreement at a later date <br />between the Contractor and Reclamation concerning <br />the Contractor1s costs of providing the stated <br />services and to the availability of future <br />congressional appropriations. The said <br />contract(s) lias to formll may also provide for the <br />construction of the improved laterals by the <br />Contractor if such is agreed upon by. Reclamation <br />and the Contractor. In the event the legal review <br />performed pursuant to subparagraph a. above states <br />that it is necessary for the Contractor to obtain <br />the consent of its electors. or in the event <br />statutory amendments are necessary, then the <br />Contractorls obligations under this subparagraph <br />d. and subparagraph b. above shall be conditioned <br />upon obtaining such approval and/or statutory <br />amendments. In the event the Contractorls legal <br />review determines that amendments to state <br />statutes are necessary, and the Colorado Attorney <br />General agrees. then the State, acting through <br /> <br />Page ~ of 10 Pages <br />
