<br />~ <br />) <br /> <br />f' <br /> <br />"sale value" of the construction and building materials. <br />Fiftv percent (50%) of the valuation of the construction <br />project as stated on the building permit shall be deemed to be <br />the "sale value" of the construction and building materials <br />used or consumed as a part thereof." <br /> <br />Section 6. AMENDMENT OF RATE OF USE TAX ON MOTOR AND OTHER <br />VEHICLES. Section 6 of said Ordinance No. 13, Series of 1979, is <br />repealed and reenacted with amendment to read as follows: <br /> <br />"Section 6. USE TAX ON MOTOR AND OTHER VEHICLES - COLLECTION. <br />The use tax imposed on motor and other vehicles on which <br />registration is required and which are purchased at retail, <br />shall be collected in an amount equal to three percent (3%) of <br />the purchased price of such motor vehicle. As set forth in <br />S39-26-208, C.R.S. 1973 as amended, no registration shall be <br />made of any such motor vehicle, and no certificate of title <br />shall be issued therefor by the Department of Revenue or any <br />of its authorized agents, until the tax which is due upon the <br />use, storage or consumption thereof pursuant to this Ordinance <br />is paid in full. The use tax imposed by this Ordinance on <br />such motor vehicles shall be collected by the authorized agent <br />of the Department of Revenue who is located in Garfield <br />County, Colorado pursuant to an agreement or agreements which <br />shall be entered into between the Town and such authorized <br />agent. The proceeds of the use tax due to the Town shall be <br />paid to the Town periodically in accordance with such <br />agreement or agreements. The Town Administrator of the Town <br />is hereby authorized to enter into, and to execute on behalf <br />of the Town any such agreement or agreements necessary or <br />advisable for the collection, administration, and enforcement <br />of this section, and such agreement or agreements to be in <br />accordance with the provisions of Colorado law including <br />specifically S24-35-ll0, C,R.S. 1973, as amended. To <br />facilitate collection of the use tax imposed on motor vehicles <br />by this Ordinance, the Board of Trustees shall certify to the <br />Department of Revenue and to the Garfield County Clerk and <br />Recorder a true copy of the currently applicable tax <br />ordinances of the Town of Silt, Colorado and shall likewise <br />certify any subsequent changes therein." <br /> <br />Section 7. <br />modified herein, <br />1979, of the Town <br /> <br />EFFECT OF ORDINANCE. Except as specifically <br />all provisions of Ordinance No, 13, Series of <br />shall remain in full force and effect. <br /> <br />Section 8. SEVERABILITY, If any section, subsection, <br />paragraph, sentence, clause, phrase, word, or other portion of this <br />Ordinance is, for any reason, held invalid or unconstitutional by <br />any court of competent jurisdiction, such portion shall be deemed <br />a separate, distinct and independent provision hereof, and such <br />holding shall not affect the validity of the remaining portions <br />hereof, the Board of Trustees hereby finding and determining that <br />the same remaining portions would have been enacted and adopted <br />without the inclusion of such unconstitutional or invalid section, <br />
