<br />"~ <br />. : \ <br />, <br /> <br />r <br /> <br />TOWN OF SILT <br /> <br />ORDINANCE NO. 23, SERIES 1993 <br /> <br />"AN ORDINANCE AMENDING ORDINANCE NO. 13, SERIES OF 1979, OF THE <br />TOWN OF SILT, COLORADO BY ADDING CERTAIN PROVISION, AMENDING OR <br />REPEALING AND REENACTING WITH AMENDMENTS CERTAIN PROVISIONS AND <br />INCREASING THE USE TAX LEVIED FROM TWO PERCENT (2%) TO THREE <br />PERCENT (3%) ON THE PRIVILEGE OF USING OR CONSUMING IN THE TOWN OF <br />SILT, COLORADO ANY CONSTRUCTION AND BUILDING MATERIALS PURCHASED AT <br />RETAIL AND FOR THE PRIVILEGE OF STORING, USING OR CONSUMING IN THE <br />TOWN OF SILT, COLORADO ANY MOTOR AND OTHER VEHICLES, ON WHICH <br />REGISTRATION IS REQUIRED WHICH ARE PURCHASED AT RETAIL." <br /> <br />WHEREAS, the Town of Silt, Colorado, (the "Town") now has in <br />full force and effect a use tax ordinance heretofore adopted in <br />accordance' with Colorado Statutes and denominated as Ordinance No. <br />13, Series of 1979; and <br /> <br />WHEREAS, Colorado law, S29-2-l02, 1973 as amended, allows the <br />Board of Trustees of the Town to levy an increased use tax approved <br />by an election to be conducted in the manner as provided by law; <br />and <br /> <br />WHEREAS, the Board of Trustees has heretofore, and does <br />hereby, determine and confirm that a use tax imposed upon (1) the <br />privilege of using or consuming in the Town any construction and <br />building materials purchased at retail and (2) the privilege of <br />stor ing, using or consuming in the Town any motor and other <br />vehicles on which registration is required which are purchased at <br />retail, would benefit the Town and the citizens thereof by <br />providing revenue in order to meet the expenses of municipal <br />government; and <br /> <br />WHEREAS, the Board of Trustees has heretofore, and does <br />hereby, determine and confirm that the Town is losing, and does <br />continue to lose, considerable potential revenues by not increasing <br />the use tax from the existing rate of two percent (2%) ,to a three <br />percent (3%) rate, to equal the rate of sales tax currently levied <br />by the Town and that it is necessary to preserve the health, safety <br />and welfare of the inhabitants of the Town to adopt this Ordinance. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE <br />TOWN OF SILT, COLORADO: <br /> <br />Section 1. PURPOSE. In pursuance of the authority conferred <br />by Colorado Revised Statutes, S29-2-l0l et seq., 1973 as amended, <br />this Ordinance is enacted for the purpose of providing additional <br />revenues to the Town to assist in the acquisition, furnishing and <br />improvements of needed services and facilities within the Town of <br />Siit, Colorado and for a town-wide underground, low-pressure, water <br />system in order to use unpotable water for irrigation. <br /> <br />Section 2.
