The town purchases treated water from <br />the City of Trinidad. There are about 82 taps on the Starkville system. <br /> <br />In June 1983 the town requested an extension on their first payment "due to <br />difficulties the town had in implementing a system for collection of water fees <br />from water users." In January 1984, $7,3 I 2 was withheld from the money still <br />owed to the town as the first repayment by the town. <br /> <br />. The June 1984 payment was received in September 1984 after a letter was sent in <br />August threatening to turn the matter over to the Attorney General for appropriate <br />action. <br /> <br />. In September 1985, the Board voted to file suit against the town for failure to <br />make their June 1985 payment. In October 1985 the AG served a summons and <br />complaint on the mayor of Starkville. The town's check was received in <br />November 1985, <br /> <br />. In 1986, the town was again delinquent. In December 1986 the AG filed suit in <br />the Las Animas District Court, Partial payments were received from the town in <br />December 1986 ($3,000) and January 1987 ($2,000). The final $2,312 was <br />received in April 1987 as part of a Stipulated Confession of Judgment which <br />recomputed the principal amount owed at $180,000. <br /> <br />. As part of the stipulated judgment, the due date for the 1987 payment was <br />extended to December 31, 1987 and the due date for the 1988 payment was <br />extended to September 30, 1988, Payments in 1989 and thereafter were to be due <br />on June 1. Our records show that the next (5th) payment received from the town <br />by the Board was not until July of 1989. (Unless the Board made a deferment of <br />which I am unaware, I suspect that the 1987 and 1988 payments were never <br />received. ) <br /> <br />. In July 1989, the Board staff asked the AG for advice on how to collect payments <br />owed by the town, and it was suggested that the matter be referred to the State <br />Controller, Division of Accounts and Control, Department of Administration. This <br />advice was followed by an August 1989 memo which discussed other measures <br />including a special tax levy, contractual remedies; garnishment, and writ of <br />execution. <br /> <br />. The June 1990 payment was received in December 1990. <br /> <br />. The June 1991 payment was again late, and a collection action was initiated <br />through the Central Collections Division in October 1991 which cost $1,609. This <br />collection fee was deducted from their payment received in December 1991. <br />However, a foundation of structured taxation levied on the residents of Starkville <br />was left intact. <br /> <br />. The June 1992 payment (7th payment received) was received in August 1992. <br />
