Inc.. <br />2186 South Hollv Street. Denver. Colorado 80222, <br />hereinal:a referred to as t~e contractor, <br /> <br />WHEREAS, authority exists ill the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered baLance thereof remains available for payment in Fund Number 4008 <br />G/L Account Number 52247, Contract Encumbrance Number C153165 : and <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencie:;: and <br /> <br />WHEREAS. '3 pursuant to the provisions of 37-60-119, Colorado <br />Revised statutes 1973, as amended, the Colorado Water Conservation <br />Boare is authorized to construct certain water projects for the <br />benefit of the people of the State of Colorado; and <br /> <br />WHEREAS, the Town of Starkville has made application t;o the <br />Colorado Water Conservation Board for the construction of a water <br />project for the purpose of improving its municip~l water supply; and <br /> <br />WHEREAS, the contractor is a professional engineering firm <br />within the state of Colorado and has previously done considerable <br />water-related work for the Town of Starkville and various other <br />municipalities in Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor agrees to prepare a feasibility report <br />directed to the problem of improving the municipal water of the <br />Town of Starkville in accordance with a proposal for project feasi- <br />bility report prepared by the Contractor and approved by the colo- <br />rado Water Conservation Board, received June 14, 1977, which <br />proposal is attached hereto as Appendix A and made .part of this <br />contract. <br /> <br />2. Fifteen (15) copies of the report called for in this <br />contract shall be furnished to the State not later than October 15, <br />1977, unless such time is extended by mutual agreement of the parties <br />hereto. <br /> <br />3. As compensation for the services of the Contractor, the <br />state agrees to pay the Contractor the sum of Four Thousand Dollars <br />($4,000) in the manner following: <br /> <br />a. Sixty percent (600/0), to wit, Two Thousand FOUr Hundred <br />Dollars ($2,400) of the total amount due in two (2) monthly install- <br />ments of One Thousand Two Hundreq Dollars ($l,2JO) each, commencing <br />on September 30, 1977. <br />b. The remaining forty p0rcent ~40%). ~: wit, OUG Thousand <br />Six Hundred Dollars ($1,600) withw thirty (30) days following <br />receipt and acceptance of the written report specified in paragraph <br />2 of this contract. <br /> <br />4. This contract is personal in nature and assignment of per- <br />formance by the contractor to another is prohibited unless prior <br />approval in writing is granted by the state. <br /> <br />5.
