WHEREAS. required approval, dearanl'e and l'C1urdinatiun has Iwen accompli~hed from and with appropriate
agencies: and

WHEREAS. a contract was entered into on December 1. 1982.
Contract Encumbrance Number 153399 ("the Original Contract").
between the State and the Contractor; and

WHEREAS. it is in the mutual interest of the State and the
Contractor to change the date on which the Contractor shall
commence making payments to the State for purchase of the
State's right. title, and interest in Phase II of the
sedgwick-Sand Draws Watershed Project and to modify the
security made available to the State; and

WHEREAS, the State and the Contractor find that they will
mutually benefit from the modification of the language, as set
forth below;

NOW, THEREFORE. it is he~ebY agreed that:

1. This Contract Amendment is a supplement to the Original
Contract (Exhibit A), which is. by this reference. incorporated
and made a part hereof. and all the terms, conditions and
provisions thereof. unless specifically modified herein, are to
apply to this Contract Amendment as though they were expressly
rewritten. incorporated, and included herein.

2. The only modifications. alterations, or changes in the
original Contract shall be that paragraphs 5 and 12 of the
Original Contract. on pages 2 and 3. respectively. of 6 pages.
shall be deleted, and in their place shall be inserted the
following substitute paragraphs:

5. a. Assign all of the Contractor1s interest in
the following real property to the State
as security for the loan:

An undivided one-half
interest in lands.
easements. and/or
rights-of-way required for
the construction Of
Sedgwick-Sand Draws
Watershed Project, all as
shown in Appendices A, B,
and C.

b. Pledge the revenue from the construction
assessments to be collected by the
Contractor over the next thirty (30) years
to the State.
