<br />Powers and Authon ties of Organization <br /> <br />The Townsite of Rico was officially initiated on September 18, <br />1891, by government patent number 96. This patent was subsequentJ.y <br />recorded in Book 17, Page 394, of the records of the Clerk and Recorder <br />of Dolores County, Dolores County Courthouse, Dove Creek, Colorado. <br />A copy of this document is available upon request. As for other docu- <br />ments, all other r1titten evidence of legal authority has been lost or <br />destroyed. <br />A copy of this document is on file at the Cortez office of Clark- <br />Thomas Engineering... and is availa1:lle upon request. <br />After searching all local 30urces with no success, a copy of the <br />Articles of Incorporation of the rOrm of Rico, complete with a cop;,. of <br />the original to'W!lsite plat, was found in the office of the Secretary of <br />State in Denver. This document confirms tne 1egal authorities vested <br />in Rico by the State of Colorado &IS a corporate entity under the general <br />le,ws of Colorado in effect at the turn of the century. In Appendix A <br />of this report is the letter containing the opinion of Clifford C. Fossum, <br />attorney for the town of Ri:co. TlUs letter affirms the legal authority <br />of Rico to enter into contract with the State of Colorado, the authority <br />to assess and tax, the authority to vest title of the project facilities <br />am the right of eminent domain.
