Unit 77-77-777, <br />WHEREAS. rf'l.juin:d arprur.d, clar:m..:f' and coordinaliun ha~ betn accomplish~d {rom and wilh ~ ro naif' <br />,.~C'nclC's: :100 PP P <br /> <br />WHEREAS. pursuant to the provisions of section 37-60-119. <br />Colorado Revised Statutes. as amended. the State is autho~ized <br />to construct certain water projects for the benefit of the <br />people of the State of Colorado; and <br /> <br />WHEREAS. the City of Greeley has made application to the <br />State for the improvement of its existing facility. such <br />improvement of the facility is hereinafter sometimes referred <br />to as ~he project; and <br /> <br />'L_. <br /> <br />WHEREAS. the Contractor is a City within the State of <br />Colorado: <br /> <br />NOW THEREFORE. it is hereby agreed that: <br /> <br />1. .T-he: Contractor shall have' a feasibili ty report prepared <br />and directed to the probl~m of~improvlpg the facilities of the <br />Hourglass Dam in accordance-with a proposal for a p~oject <br />feasibili~y report prepared by the consulting engineering firms <br />of McCall. Ellingson. and Morrill and Woodward-Clyde and <br />Associates (the Consultant) and approv~d by the State. dated <br />October 19. 1989. which proposal'is attached hereto'as Appendix <br />A and made a part of this contract. <br /> <br />2. Fifteen (15) copies of. the final report called for in <br />this contract shall be furnished to the Sta~e not later than <br />ninety (90) days after the date of this contract. unless such <br />time is extended by mutual agreement of the parties hereto in <br />writing. <br /> <br />3. As compensation tor the services of the Contractor. the <br />State shall pay to the Contractor the sum of Twenty Thousand <br />Dollars ($20.000) in the manner following: <br /> <br />a. Sixty percent (60%). to wit. 1velve Thousand Dollars <br />($12.000) of the total amount due in two (2) monthly <br />installments of Six Thousand Dollars ($6.000) each. <br />commencing fifteen (15) days atter the date of this <br />cont.ract. <br /> <br />U. 7he :em.:.;.ininy forr.y per:cen't tqU~).
