<br />4. Except as otherwise 'provided by .hlw. if this coniract provides for the payment of. more,than fiye thousand
<br />dollars. and fefluires or involves tlie emp[oymei1t of laborers or mechanics in the construction, alteration or repair of
<br />any building or other public ~~'ork, (except_ highw:lYs, highway bridges, underpasses and highway structures' of ~Jl.
<br />kinds) within the geographical limits of the Stnte, the rate of wage for all laborers and mechanics employed by the
<br />coiltractor or any subcontractor on the building or p~blic work covered by this contract shall be not less than the
<br />prevailing rate of wages for work of a similar nature ill the city, town, village or other civil subdivision of the State in
<br />which the building or oth.er public work.is located. Disputes respecting prevailing ra~es will be resolved as pro~.ided in
<br />8-16-101, CRS 1973. as ainended.

<br />
<br />5. 1l1e cont~ctor agrees to comply with the letter and spirit of the Colorado Antidiscrimination Act of 1957,
<br />as amend~d, alld other applicable law respecting discrimin;ltiOll and unfair employment practices (24-34-301, CRS'
<br />1973, as amended), and as required by'Executive Or~er, Equal Op,portul1ity and Affirmative Action, dated Apri116,
<br />1975. Pursuant tl!ereto, the following provisions sllall he contained ill all State controcts or su1r.contracts.

<br />During the perfonnance of this contract, the Cl;mtractor .agrees as follows:
<br />
<br />(I) The contractor will not discriminate against any employee or applicant for employment because of
<br />race. creed, color, national origin, s'ex, marital status, religion, ancestry, mental or phySicafhandicap, or age.
<br />TIle contractor .will take affirmative action to insure tna.t applicants are. employed, and that employees 3re
<br />treated during employme~t, without regard to the above mentioned characteristics. Such action shall include,
<br />but - not be limited to the following: employment, upgrading, demotion, or transfer, recruitment .Of
<br />recruitment advertising'5: lay-offs or tenninations: rates of payor other fonns of compensation; and selection
<br />for _training~ including apprenticeship. The contractor agrees to post in conspicuous places, available to

<br />(2) The contractor ~vilL in all soli~itations ~r advertiseme'nts for employees placed by or on behalf of the
<br />contractor; state that all qualified applicants will receive consideration for employment without regard to
<br />race, cree~, color, national origin, sex, marital status, religion,.ancestry, mentUl or physical handicap, or age.

<br />(3) The contractor will send to each labor union or representative of workers with whi~h he l1as collective
<br />bargaining agreement or other contract or understanding, notice to be provided by the contracting offk;er,
<br />advising the labor union or workers' representative of the contractor's committment under the Executive
<br />Order, Equal Opportunity and. Affinnatj\'e Action, dated April 16, 1975, and of the rules, regulations, and
<br />relevant Orders of the Govemor.
