Engelke <br />City Manager <br />City of Fruita <br />101 W.McCune <br />Fruita, CO 81521 <br /> <br />Dear Mr. Engelke: <br /> <br />I am writing in reference to two contracts between the Town <br />of Fruita ("Fruita") and the COlorado Water Conservation Board <br />("CWCB"). Contract Encumbrance Number C153382. dated May 1. <br />1982 ("the May 1 Contract") and Contract Encumbrance Number <br />C153396. dated December 1, 1982 ("the December 1 Contract"). <br />The CWCB has considered Fruita's financial problems. and <br />intends at this time. subject to the conditions set forth <br />below. to allow Fruita to defer making the annual payments of <br />$12.232.74 due under the May 1 Contract on May 1 of 1987. 1988. <br />and 1989. and the annual payments of $30.709.26 due under the <br />December 1 Contract on December 1 of 1987. 1988. and 1989. <br /> <br />The CWCB will delay demanding these payments provided that <br />Fruita agrees to inform the CWCe in writing on or before <br />November 1, 1989. about Fruita's general fiscal position. and <br />specifically about the provisions in Fruita's 1990 budget for <br />resuming annual payments under both contracts. I would then <br />expect that the CWCB and Fruita would negotiate amendments to <br />both contracts which would establish the dates on which Fruita <br />would make the deferred annual payments for 1987. 1988. and <br />1989. The CWCB's willingness to defer payments is also <br />conditioned on Fruita's agreeing at the present time that any <br />such contract amendments would require Fruita not only to make <br />up the three deferred annual payments. but also to pay interest <br />on those payments for the periOd running from the date on which <br />each payment is due under the original contract, through the <br />date on which each payment is actually made. I would request <br />that you inform me in writing as to whether Fruita agrees to <br />provide the CWCB by November 1. 1989 with the financial and <br />budgetary information referred to above. and to pay interest ~n <br />any deferred annual payments. <br /> <br />3654E <br /> <br />,..... <br /> <br />o\~'. <br />
