1. Tremont wilt rebuild its canal, the Tremont Ditch. and diversion

works so that its hcadgale wilt be located in the Soutf1cast Quarter (SBl/4)

of Section Twenty_{h'e (Z5). Township Four (4) North. Range Fifty-seven

(57) West or the Sixth (6th) Principal Meridian on the n<?rth~dge of the

South Platte River at a point three hundred feet (300') to five hundred feet

:500') upstream [rom the dam and diversion works of Lower Platte, and

so that its canal will run {rom thence in a northerly and northeasterly

direction into the Northeast Quarter (NEl/4) of said Section Twenty-five

(25) to continue into and COI:.ncct witb the Tremont Ditch as presently con-

&tructed and thus eliminate thc old portion of the Tremont Ditch whi..;" al-

U. In consideration of which, Lower Platte will at all times main-

tain its dam. div~r6ion works and checks and f1at;h1,ojrds loc:lted in and

on the said South pl.atte River in the Southeast Quarte' (SEl/4) of said

Section Twenty_five (25) in such a manner so that the still water pond im-

pounded thcreby wiU extend up~h'eam, and so that the surface of the water

in tluch still water pond will be at a sw!:cient height t<) allow full diversion

of water by gravity {low into the Tremont Ditch hCbdC<.lte and c~nal to !ill

all of Tremont's water rights and water decrees provided, however, that

this will not interfere with the normal operation and maintenance of Lower

Platte.
