CONTRACT

THIS CONTRACT, made this i l-th day of flvvvC/h 2000, by
and between the State of Colorado for the use and benefit of the Department of Natural
Resources, Colorado Water Conservation Board, hereinafter referred to as the CWCB and/or
STATE, and the Board of County Commissioners of Baca County, State of Colorado, 741 Main
Street, Springfield, Colorado 81073, hereinafter referred to as the CONTRACTOR,

FACTUAL RECITALS

A. Authority exists in the law, and funds have been budgeted, appropriated and otherwise
made available and a sufficient unencumbered balance thereof remains available for
payment in Fund Number 100 Organization YYYY, Appropriation SEV, GBL 6031 Program
WTRC, Object Code 5120, Reporting Category 0031, Contract Encumbrance Number
C150031,

B, Required approval, clearance, and coordination have been accomplished from and with
appropriate agencies,

C, Pursuant to Section 39-29-109(1)(a), C.R.S, (1999), the STATE is authorized to fund water
resource planning at the local level from the Operational Account of the Severance Tax
Trust Fund.

D. The CONTRACTOR, in cooperation with the Southern High Plains Ground Water
Management District ("DISTRICT"), is coordinating the Southern High Plains Ground Water
Management District Water Resource Study ("STUDY"), which will involve an evaluation of
existing ground water data in the Southern High Plains Designated Ground Water Basin to
enable the District and the CONTRACTOR to develop measures to protect the future value of
existing ground water supplies in the Ogallala Aquifer.

E. The STATE has determined that the information compiled in the STUDY will assist in local
water resource planning efforts both in the STUDY area,

F, The CONTRACTOR shall direct the performance of the STUDY in coordination with the
DISTRICT and in cooperation with the Colorado Water Conservation Board and the Colorado
Division of Water Resources ("WATER RESOURCES").

G, The CONTRACTOR and the District have selected McLaughlin Water Engineers, Ltd, of
Denver, Colorado ("CONSULTANT") to conduct the STUDY and have approved a scope of
services for the STUDY tasks prepared by the CONSULTANT,

H. The CWCB approved the expenditure of $75,000 from the Operational Account of the
Severance Tax Trust Fund to participate in the STUDY at its May 1998 meeting,
