Authority exists in the law, and funds have been budgeted, appropriated and otherwise <br />made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 100 Organization YYYY, Appropriation SEV, GBL 6031 Program <br />WTRC, Object Code 5120, Reporting Category 0031, Contract Encumbrance Number <br />C150031, <br /> <br />B, Required approval, clearance, and coordination have been accomplished from and with <br />appropriate agencies, <br /> <br />C, Pursuant to Section 39-29-109(1)(a), C.R.S, (1999), the STATE is authorized to fund water <br />resource planning at the local level from the Operational Account of the Severance Tax <br />Trust Fund. <br /> <br />D. The CONTRACTOR, in cooperation with the Southern High Plains Ground Water <br />Management District ("DISTRICT"), is coordinating the Southern High Plains Ground Water <br />Management District Water Resource Study ("STUDY"), which will involve an evaluation of <br />existing ground water data in the Southern High Plains Designated Ground Water Basin to <br />enable the District and the CONTRACTOR to develop measures to protect the future value of <br />existing ground water supplies in the Ogallala Aquifer. <br /> <br />E. The STATE has determined that the information compiled in the STUDY will assist in local <br />water resource planning efforts both in the STUDY area, <br /> <br />F, The CONTRACTOR shall direct the performance of the STUDY in coordination with the <br />DISTRICT and in cooperation with the Colorado Water Conservation Board and the Colorado <br />Division of Water Resources ("WATER RESOURCES"). <br /> <br />G, The CONTRACTOR and the District have selected McLaughlin Water Engineers, Ltd, of <br />Denver, Colorado ("CONSULTANT") to conduct the STUDY and have approved a scope of <br />services for the STUDY tasks prepared by the CONSULTANT, <br /> <br />H. The CWCB approved the expenditure of $75,000 from the Operational Account of the <br />Severance Tax Trust Fund to participate in the STUDY at its May 1998 meeting, <br /> <br />Page 1 of 7 <br />
