. <br />, � .' <br />l <br />compliance of contractors and subcontractors with the Equal Opportunity <br />(Federally Assisted Construction) clause and the rulea, regulations, and <br />relevant orders of the Secre[ary of Labor, that it will furnish the Contracting <br />Officer and the Secretary of Labor such information as they may require for the <br />superviaion of such compliance, and that it will otherwise assist the <br />Contracting Officer in the discharge of his primary responsibility for <br />securing compliance. <br />(d) The Contractor further agrees that it will refrain from entering <br />into any contract or contract modification sub�ect to said amended Executive <br />Order with a contractor debarred from, or who has not demonstrated eligibility <br />for, Government contracts and federally assisted construction contracts pursuant <br />to said amended Executive Order and will carry out such sanctions and penalties <br />for violation of the Equal Opportunity (Federally Assisted Construction) clause <br />as may be imposed upon contractors and subcontractors by the Contracting Officer <br />or the Secretary of Labor pursuant to Part II, Subpart D, of the Executive <br />Order. In addition, the Contractor agrees that if it fails or refuses to comply <br />with these undertakings, the Contracting Officer may take any or all of the <br />following actions: Cancel, terminate, or suspend, in whole or in part, this <br />contract; refrain from extending any further assistance to the Contractor under <br />the program with respect to which its failure or refusal occurred until <br />satisfactory assurance of future compliance has been received from such <br />contractor; and refer the case to the Department of Justice for appropriate <br />legal proceedings. <br />COMPLIANCE WITH CIVIL RIGHTS LAWS AND REGULATIONS <br />31. (a) The Contractor shall comply with Title VI of the Civil Rights Act <br />of 1964 (42 U.S.C. 2000d), Section 504 of the Rehabilitation Act of 1975 (P.L. <br />93-112, as amended), the Age Discrimination Act of 1975 (42 U.S.C. 6101, et <br />seq.) and any other applicable civil rights laws, as well as with their <br />respective implementing regulations and guidelines imposed by the U.S. <br />Department of the Interior and/or Bureau of Reclamation. <br />(b) These statutes require that no person in the United States shall, <br />on the grounds of race, color, national origin, handicap, or age, be excluded <br />from participation in, be denied the benefits of, or be otherwise subjected to <br />discrimination under any program or activity receiving financial assistance from <br />the Bureau of Reclamation. By executing this contract, the Contractor agrees to <br />immediately take any measures necessary to implement this obligation, including <br />permitting officials of the United States to inspect premises, programs, and <br />documents. <br />(c) The Contractor makes this agreement in consideration of and for <br />the purpoae of obtaining any and all Federal grants, loans, contracts, property <br />discounts or other Federal financial assistance extended after the date hereof <br />to the Contractor by the Bureau of Reclamation, including installment payments <br />after such date on account of arrangements for Federal financial assistance <br />which were approved before such date. The Contractor recognizes and agrees <br />that such Federal assistance will be extended in reliance on the representations <br />and agreements made in this article, and that the Uni[ed States reserves the <br />right to seek �udicial enforcement thereof. <br />32 <br />
