<br />;:"fRlO.A('-02A <br /> <br />A O. <br />DEPA!'- ~- ENT OR AGENCV NUMBER <br />, , 04-00 <br />CONTR"ACT ROUTING NUMBER <br /> <br /> <br />CONTRAcr <br /> <br />$354,113.57 <br /> <br /> <br />196 I, by and bctw<<u the <br />Resources <br /> <br />ists w and Funds have been budgeted. appropriated and otherwise made <br />d balance thereof remains ava~w, fo~aYment in Fund Number 4008 . <br />, Conlract EnclImbr.mcc NlImbtrC~.:L3 Qend <br /> <br />S. required appruval. clearance and coordination has been accomplished from and with appropriate <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-119, <br />Colorado Revised Statutes 1973, as amended, the State is <br />authorized to construct certain water projects for the benefit <br />of the people of the State; and <br /> <br />WHEREAS, the Contractor is a duly constituted town in the <br />State of Colorado and wishes to improve its existing water <br />supply system," hereinafter called the project, for the citizens <br />of the Town of Basalt in Eagle County, Colorado, at an <br />estimated cost of approximately Three Hundred Fifty-Five <br />Thousand Dollars ($355,000), and <br /> <br />WHEREAS, a feasibility investigation of said project was <br />conducted and it was found that such a project is economically <br />feas ible; and <br /> <br />WHEREAS, the State has agreed to construct said project and <br />to sell the same to the Contractor upon mutually agreeable <br />terms and conditions, subject to the availability of funding <br />for that purpose; and <br /> <br />WHEREAS, pursuant to Senate Bill No. 69, Fifty-First <br />General Assembly of the State of Colorado, duly enacted into <br />law, the Colorado Water Conservation Board has been authorized <br />to exn~nd a sum not to exceed Six Hundred Thousand Dollars <br />($600,000) for construction of the project; and <br /> <br />WHEREAS, the Contractor has already incurred Three Hundred <br />Fifty-Four Thousand One Hundred Thirteen Dollars and <br />Fifty-Seven Cents ($354,113.57) of expenses on prior portions <br />of the project, which expenses have been documented by the <br />Contractor to the State's satisfaction. <br /> <br />NOW THEREFORE, in consideration of the mutual and <br />dependent covenants herein contained, it is agreed by the <br />parties hereto as follows: <br /> <br />A. The Contractor agrees that it shall: <br /> <br />1. Employ an engineering firm to prepare project plans <br />and specifications for the proposed project. Both the <br />engin~ering firm and the project plans and specifications shall <br />be approved by the State. <br /> <br />2.
