Mav State of Colorado for the use and benefit of'the Department of ~1 ~nlnr~nn War.p-r conservation Board hereina.fter referred to as the State, and ~2 'R W ~p('''k 1:- A~~o("'i ;::ITP!'; don Prl1no:>ni-i;::ll 'Pl ;::l7.;::l D-=>Y1"'I7Ar Color;:'lnn RO?:O? her~inafter referred to as the contractor, 197.4., by and between the Natural Resources; WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains availa~ for payment in Fund Number 1001 G/L Account Number 51 q ,X, Contract Encumbrance Number 14 2r ~ and " WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies: and WHEREAS, ~3pursuant to"the provisions of 149-1-22, Colorado 'Revised Statutes 1963, as amended, the Colorado Water Conservation Board is authorized to construct certain water projects, for the benefit of the people of the state of, Colorado; and WHEREAS, "the city of 1:lanitou Springs has made application to "b.~e Board for the construction of a water project for the, purpose of supplying municipal and industrial water to the inhabitants of 'the areas served by the applicant; and vrrlEREAS, the Contractor is a professional engineering firm within the state of Colorado, and has previously done considerable water- "related work for the city of Manitou $prings; NOW THEREFORE, it is hereby agreed that 1. ~4 The Contractor agrees to prepare a feasibility report to study the City's existing water supply and distribution system and the development 'of a plan of improvements and additions in accordance with a proposal for project feasibility report prepared by the Con- tractor and approved by the Colorado Water Conservation Board, dated April, 1974, which proposal is attached hereto as Exhibit A and made a part of this contract~ 2 ~ Thirty, (30) copies of the report called for in this con- tract shall be furnished to the State not later than October 31, 1974, unless such time is extended by mutual agreement of the parties hereto. 3. As compensation for the services of the Contractor, the State agrees to pay to the Contractor the sum of Sixteen Thousand Dollars ($16,000) in the manner following: / a. Sixty percent (60%) of the total amount due in two (2) equal monthly installments commencing on July 31, 1974." b. The rema,n,ng forty percent (40%) within thirty (30) days following receipt and acceptance of the written report specified in paragraph 2 of this contract.""
