<br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made

<br />WHEREAS. re4uired appro\'al. clearance and coordination has been accomplished (rom and with appropriate
<br />agencies; and
<br />
<br />WliEREAS, pursuant to the provisions of 37-60-119, Colorddo
<br />Revised Stdtutes 1973, as dmended, the State is authorized to
<br />construct certatn water projets for the benefit of the people of
<br />the Stdte of Colorado; and
<br />
<br />WHEREAS, Fuchs Ranches, lnc., ha5 made appl iCdUon to the
<br />State for the improvement of its existing facilitYi and
<br />
<br />WHEREAS, the Contractor is an incorporated company within
<br />the Stdt~ of Colorddoj
<br />
<br />NOW THEREFORE, it is hereby agreed that
<br />
<br />1. The Contractor shdll have d fcasibi,lity report prepared
<br />clnd direct~d to the problem of improving the facilities of the
<br />Fuchs [)..t"1l In dccord..1nce with d proposal for a project fcasibll it..,
<br />report pre~ared by the consulting engi/lecring firm of
<br />Hydro-Triad, Ltd. (the Consultant), and approved by the State,
<br />recelvE.-~ Jc:.y 27, i981, which proposal is attached hereto as
<br />Appendl~ "~" dnd and made a part of t~lls contract.

<br />2. Fifteen (15) copies of the ri,ndl report called for In
<br />thls contr::.ct shell be furnished to the Sldte nol later Lhan
<br />Dect:fiiD.:-f 1, 1931, unless such time is ex;tended by mutual
<br />agreement of the pa~tles hereto in wrLting.

<br />3. As compensation for the s.ervi.ces of the Contractor, the
<br />State shall pay to the Contractor the sum of Four lllousdnd Two
<br />Hundred Dollars ($4,200) in tile manner following:
<br />
<br />a. Sixty percent (60%), to wit, Two Thousdnd Five
<br />Hundred Twenty Dollars ($2,')20) of lhe lotd} i:lmount due
<br />in two (2) monthly installments of One Thousand Two
<br />Hundred Sixty Dollars ($1,260) each, commencing on
<br />October 1, 1981.
<br />
<br />b. The rema.Lning fort)' percent (l.W-ti), to wjt,
<br />One Thousand Six Hundred Eighty Dolldrs ($1,680) within
<br />forty (40) days following r~cclpt and acccptdncc of the
