<br />WHEREAS, reljuired approval, c1carance and coordination has been accomJllished from and wilh appropriate
<br />agencies; and

<br />WHEREAS, ') pursuant to the provisions of 37-60-119, Colorado
<br />Revised Statutes 1973, as amended, the State is authorized to
<br />construct certa.Ln wateL' projects fOL' the benefit of the people

<br />WHEREAS, the Contractor is a water district in the State
<br />of Colorado and wishes to improve its p.cesent rlamestic wate,'
<br />supply system, he.ceinafteL' called the project, faL' the waLe,'
<br />district in Summit County, Colorado, at an estimated cost of
<br />Two Million Four Hundred Thousand Dollars ($2,400,000): and
<br />
<br />WHEREAS, a feasibility investigation of said project was
<br />conducted and it was found that such a project is ecorlomically
<br />feasible: and
<br />
<br />WHEREAS, the State has agreerl to constL'uct said pL'oject and
<br />to sell the same to the Contractor upon mutually agreeable
<br />terms and conditions, subject to the availahility of fuw'linC)

<br />WHEREAS, pursuant to Senate Bill No. 439, Fifty-Third

<br />parties hereto as follows:

<br />A. The Contractor agrees that it shall:

<br />1. Employ all enginee.c ing firm to p.cepa.ce pL'oject plans
<br />and specifications fOL' the PL"Oposec'l project. Both the
<br />engineeL'inq fiL'm aflo t.he pl.'oject plnus and speclflcatiofH,l ~ha.l.J.
<br />be approved by the State.

<br />2. Sub-contL"act the construction of said pc-oject to a
<br />responsible and capable firm, said pc()jecL, Lo he cornpleten
<br />within two (2) yeaL'S of the date of this contL'act in acconlance

<br />modification thereof.approved by the State. The State must
