Form 6-AC.02 \...' . i,lAlc. 7&' 3F DEP!R;MENT OR AGENCY N -04-00 CONTRACT ROUTING NUMBER 4257 $5,936.50 CONTRACT THIS CONTRACT, made (his 11)t:h day of .Tune State of Colorado for the use and benefit of the Department of " (Colorado Water Conservation Board) he{ei'ilafter referred to as the State, and "2 Ne1!=wn, Haley, Pat:t:er~on 760 Horizon Drive J Gra.nd Tllncti on r Co1or::Ldo 81501 "hereinafter referred to as the contractor, 197.6., by and between the Natural Resources and QPirk, Tnc., WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 , G/L Account Number 52147, Contract Encumbrance NumberC153140..; and WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS," pursuant to the provisions of 37-60-119, Colorado Revised Statute9 1973, as amended, the Colorado Water Conservation Board is authorized to construct certain water projects for the benefit of the people of the State of Colorado; and WHEREAS, the Town of Fruita has made application to the Colorado Water Conservation Board for the construction of a water project for the purpose of improving its municipal water supply; and WHEREAS, the Contractor is a~professional engineering firm within the State of Colorado and has previously done considerable water-related work for the Town of Fruita and various other municipalities in Colorado; NOW THEREFORE, it is hereby agreed that 1. The Contractor agrees to prepare a feasibility report directed to the problem of improving the municipal water of the Town of Fruita in accordance with a proposal for project feasibility report prepared by the Contractor and approved by the Colorado Water Conservation Board, received May 24, 1976, which proposal is attached hereto as Appendix A and made a part of this contract. 2. Fifteen (15) copie9 of the report called for in this contract shall be furnished to the State not later than September 1, 1976, unless such time i9 extended by mutual agreement of the parties hereto. 3. As compen9ation for the services of the Contractor, the State agrees to pay the Contractor the sum of Five Thousand Nine Hundred Thirty-Six Dollars and Fifty Cents ($5,936.50) in the manner following: a. Sixty percent (60%), to wit, Three Thousand Five Hundred Sixty-One Dollar9 and Ninety Cents ($3,561.90) of the total amount due in two (2) monthly installments of One Thousand Seven Hundred Eighty Dollars and Ninety-Five Cents ($1,780.95) each, commencing on July 15, 1976. b.
