<br />Form 6-AC.02 <br /> <br />\...' <br /> <br />. <br /> <br />i,lAlc. 7&' 3F <br />DEP!R;MENT OR AGENCY N <br />-04-00 <br />CONTRACT ROUTING NUMBER <br />4257 <br /> <br />$5,936.50 <br /> <br /> <br />CONTRACT <br /> <br />THIS CONTRACT, made (his 11)t:h day of .Tune <br />State of Colorado for the use and benefit of the Department of " <br />(Colorado Water Conservation Board) <br />he{ei'ilafter referred to as the State, and "2 Ne1!=wn, Haley, Pat:t:er~on <br />760 Horizon Drive J Gra.nd Tllncti on r Co1or::Ldo 81501 <br />"hereinafter referred to as the contractor, <br /> <br />197.6., by and between the <br />Natural Resources <br /> <br />and QPirk, Tnc., <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 , <br />G/L Account Number 52147, Contract Encumbrance NumberC153140..; and <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br /> <br />WHEREAS," pursuant to the provisions of 37-60-119, Colorado <br />Revised Statute9 1973, as amended, the Colorado Water Conservation <br />Board is authorized to construct certain water projects for the <br />benefit of the people of the State of Colorado; and <br /> <br />WHEREAS, the Town of Fruita has made application to the <br />Colorado Water Conservation Board for the construction of a water <br />project for the purpose of improving its municipal water supply; and <br /> <br />WHEREAS, the Contractor is a~professional engineering firm <br />within the State of Colorado and has previously done considerable <br />water-related work for the Town of Fruita and various other <br />municipalities in Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor agrees to prepare a feasibility report directed <br />to the problem of improving the municipal water of the Town of Fruita <br />in accordance with a proposal for project feasibility report prepared <br />by the Contractor and approved by the Colorado Water Conservation <br />Board, received May 24, 1976, which proposal is attached hereto as <br />Appendix A and made a part of this contract. <br /> <br />2. Fifteen (15) copie9 of the report called for in this contract <br />shall be furnished to the State not later than September 1, 1976, unless <br />such time i9 extended by mutual agreement of the parties hereto. <br /> <br />3. As compen9ation for the services of the Contractor, the State <br />agrees to pay the Contractor the sum of Five Thousand Nine Hundred <br />Thirty-Six Dollars and Fifty Cents ($5,936.50) in the manner following: <br /> <br />a. Sixty percent (60%), to wit, Three Thousand Five Hundred Sixty-One <br />Dollar9 and Ninety Cents ($3,561.90) of the total amount due in two <br />(2) monthly installments of One Thousand Seven Hundred Eighty Dollars <br />and Ninety-Five Cents ($1,780.95) each, commencing on July 15, 1976. <br /> <br />b. The remaining forty percent (40%), to wit, Two Thousand Three <br />Hundred Seventy-Four Dollars and Sixty Cents ($2,374.60) within <br />thirty (30) days following receipt and acceptance of the written <br />report specified in paragraph 2 of thi9 contract. <br /> <br />4. <br />formance <br />appr,?val <br /> <br />This contract is personal in nature and assignment of per- <br />by the Contractor to another is prohibited unless prior <br />in writing is granted by the State. <br /> <br />5.
