WH~REAS. authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a 5urticienl unencumbered balance thereof remams available (or payment in Fund Number 4008 <br />G/L Account Number 528 SX, Contract Encumbrance Numbeei !5.:~~9So! and . <br />ABL Account No. 12850, Org. Unit 77-77-777, <br /> <br />,WHEREAS. re4uired appniy.d. clearance and coordination has been accomplished from and with appropriate <br />agencies; and " <br /> <br />WHE"HEAS. pursuant to the prOVISIons o_f" section 37-60-119. <br />Colorado Revised Statutes. as amended. the State is authorized <br />to construct certain water projects for the benefit o~ the <br />people of the State of Colorado: and <br /> <br />WHEREAS. the City of Loveland has made application to the <br />State for the improvement of its existing facility. such <br />improvement of the facility is hereinafter sometimes referr"ed <br />to as the project: and <br /> <br />WHEREAS. the Contractor is a municipal corporation within <br />the State of Colorado: <br /> <br />NOW THEREFORE. it is hereby agreed that: <br /> <br />1. The Contractor shall have a feasibility report prepared <br />and directed to the problem of expanding its-water supply <br />system in accordance with proposals for a proje9t feasibility <br />report prepared by the conSUlting engineerin'g firm of Camp <br />Dresser & McKee Inc. (the Consul~ant) and approved by the <br />State. received February 12. 1987. Phase II and Phase III. <br />which proposals are attached hereto as Exhibit A and made a <br />part of this contract. <br /> <br />2~ Fifteen" (15) copies of the final report called for in <br />this contract shall be furnished to the State not later than <br />December 1..1987. unless such time is extended by mutual <br />agreement of the parties hereto in writing. <br /> <br />3. As compensation for the services of the Contractor. the <br />State, shall pay to the Contractor the sum of Sixty-Eight <br />Thousand Four Hundred Two Dollars and Fifty Cents ($68.402,50) <br />in the manner following: <br /> <br />a. Sixty percent (60\). ~o wit. Fo~~y-One Thousand <br />FOrty_On,e Dollars and Fifty Cents ($41.041.50) of the total <br />amount due in two (2) monthly installment~ of Twenty <br />Thousand Five Hundred Twenty Dollars and Seventy-Five Cents <br />($20.520.75) each. commencing on July ~~" 1987. ~"'''''11 <br />MIl-V""" <br />b. The remaining forty percent (40\). to wit.
