Colorado 80203

Re: Contract with the Colorado Water
Conservation Board for imorovement of
Louisville raw water storage

Dear Mr. loannides:

The purpose of this letter is to provide an op1.nwn relative to the
above captioned matter. Please be advised that the Mayor is authorized to
execute contracts on behalf of the City of Louisville with the Mayor's signature
to be attested by the City Clerk. The Mayor does have authority to bind the City
with respect to any contract which has been approved by the City Council. The
contract with respect to the above captioned matter was specifically approved by
the Louisville City Council, with a COpy of the minutes of the Council meeting
attached to this letter. Norbert A. Meier is the duly elected Mayor of the
City and has authority to execute contract documents.

Under the Colorado Revised Statutes and the Colorado Constitution,
Louisville City Council has authority to enter into the above captioned coutract.
This contract may be approved without a vote of the citizens because it involves
construction and improvments of water supplies which are exempt from a vote by
the citizens. No provisions of the Municipal Code of the City of Louisville or
IDlY provisions of which I am aware in the State Statutes prevent the above captioned
contract from being binding upon the City. Therefore, it is my opinion, said
contract would be valid and binding against the City of Lousiville.

If you have any questions cOncerning this matter or desire further
information, please do not hesitate to contact me.

~

Yours very

Curt Rautenstraus
City Attorney

CDRlsw
