<br />full payment shall be conveyed by the State to Carbon- <br /> <br />. dale; <br /> <br />4) Until full payment of the sums referred to above by <br />Carbondale to the State, Carboodale shall maintain ex- <br /> <br />elusive .possession of the pipelines, water.pump stations, <br />and water meters referred to above, as.long as Carbon- <br /> <br />" <br /> <br />dale complies with the provisions of the contract be- <br />tween the Town of Carbondale and the State; <br />5) The transaction between Carbondale and the State of <br /> <br />Colorado is ~ot a sale and disposition of waterworks <br />or other real property used for governmental purposes <br />within the meaning of C,R.S,' 1973, 31-15~713. but is a <br />transaction designed to permit the Town of Carbondale <br /> <br />to acquire and construct improvements and extensions to <br />its water facilities without the necessity of an elec- <br /> <br />tionj <br /> <br />6) The construction of improvement~ and enlargements to <br />the Carbondale waterworks and t~e execution and perform- <br />ance of the contract between th~ Town of Carbondale and <br /> <br />the State are necessary for the Town and its inhabitants, <br /> <br />and are necessary and proper to provide for the safety, <br />to preserve th~ health, to promote the prosperity, and <br />to improve the order of the Town and its inhabitants; <br />7) The agreement referred to above between the Town of Car- <br />bondale and the State, is dated May IS, 1976 and is on <br />file and open for public inspection during regular busi- <br />ness hours at the Town Hall, Town of Carbondale, Colorado; <br />8) It is imperitive that the contract between the Town of <br />Carbondale and the State be executed as soon as possible <br /> <br />so that constru~tion may begin and water may be supplied <br /> <br /> <br />to the Carbondale Waterworks in order to fulfill the <br /> <br />needs of those presently without sufficient water within' <br /> <br />-2- <br />
