From previous decrees for the water rights of Union Ditch (see <br />also Case 80CW93 mentioned above): <br /> <br />A. Dated entered: February 3,.1894 (no case number). <br /> <br />B. Decreed Point of Diversion (see also maps attached as <br />Exhibit A): The headworks of the Minnequa Canal is located on the <br />south bank of the Arkansas River in the NW 1/4, Sec. 7, T. 19 S., <br />R 69W. Of the 6th P.M. in Fremont County. <br /> <br />, . <br />C. Source: Arkansas River. <br /> <br />D. Appropriation Date: November 30, 1861.' <br /> <br />E. Amount: 48 cfs <br /> <br />F. Historic Use: The water rights listed in paragraph 2 of <br />this Application have historically been used for irrigation <br />purposes with a consumptive use of 32% as a percentage of water <br />diverted. The area irrigated is shown on map' attached, as Exhibit <br />A. summaries of diversion records are attached as Exhibit B. <br /> <br />4. Proposed Change: Applicants propose to change the' use of the <br />subject water to municipal, 'domestic, industrial, agricultural, <br />commercial, irrigation, stock watering, recreation, fish and <br />wildlife, fire protection and other beneficial uses including <br />augmentation, substitution and exchange. Such water may be <br />immediately applied to beneficial use, or stored and subsequently <br />aPPlied to 'beneficial use, for exchange purposes, for replacement <br />of depletions resulting from the use of water from other sources, <br />and for all other augmentation purposes including taking credit for <br />all return flows as augmentation for or as offsets against out-of- <br />priority tributary depletions as provided in said decree in 80CW93 <br />and any decree entered in this case. Applicants also propose to <br />store subject water in the Florence-Coal Creek-Wil1i~sburq <br />Reservoir, located on'Oak Creek in the west half, Sec. 17 and east <br />half of Sec. 18, T195, R69W of the 6th P.M. in Fremont County. <br />This reservoir was adj'udicated by Decree dated May 26, 1982 <br />(recorded June 11, 1982 at reception no. 487401, Book ,677, Page <br />456) in Case 80CW92 in this Court. This reservoir has as its <br />source oak Creek water and Arkansas River water diverted at, the <br />said Minnequa Canal. No change in the point of diversion from the <br />Arkansas River is requested. Applicants' proposed plan of <br />operation is the same as in Case 80CW93, as that was revised by the <br />Decree of this Court in Case 86CW120. <br /> <br />\30U. <br /> <br />2 <br />
