<br />the Nl/2, Sec. 35, T20S, R70W.
<br />(IS) Flcrence City Water Works Pipeline 'and Reservoirs,
<br />adjudicated February 14, 1916 in Case 2637, Fremont County District Court, date
<br />of constru~tion Fetruary 28, 1898, taking water from Newland (a/k/a. Newlin) Creek
<br />and located as follows:
<br />(i) Upper intake: a point which bears south 46038' west
<br />3075 feet from the NE corner, Sec. 35, T.20S, R.70W of
<br />the 6th P.M.
<br />(ij) Second intake: a point which accc:rding to said decree
<br />bears 9041' east 1262.3 feet from the NE corner, Sec.
<br />35, T20S, R70W. Historically and presently diverted in
<br />the N 1/2, Sec. 35, T20S, R70W.
<br />(iii) Reservoirs I, 2 and 3, located in the El/2 NWl/4 of
<br />Sec. 4, T20S, R69W.
<br />and entitled to the entire flow of Newland Creek, including flood waters, to the
<br />extent of 5 cfs, which may be diverted by said pipeline and may be stored in said
<br />reservoirs, which have a decreed capacity of 50 million g8.llons (154 acre feet), 30
<br />million gallons (92 acre feet), and 45 million gallons (J38 ac~e feet), respectively.
<br />(16) Jane R. Smith Water Right, appropriation date June 21, 1870,
<br />for the entire natural flow of Newland Ca/k/a Newlin} Creek during the s{I"ing and
<br />summer irrigation season, including flood waters, to the extent of 5 efs, entitled to
<br />Arkansas River Priority No. 10, being Hardscrabble Creek Priority No. 1 and
<br />Newland Creek Priority No.1, at lXlints located as described in subparagraph (15)
<br />hereinabove, all as set forth in said decree in Case 2637 of the Fremont County
<br />District Court dated February 14, 1916, with right to fill and refill reservoirs.
