<br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />August 8, 1995 <br />Honorable Mayor Rippy and Board of Trustees <br />Town of New Castle <br />Page 2 <br /> <br />Attached to Mr. Bussone's letter were several enclosures of which included flow records for <br />East Elk Creek, Main Elk Creek and West Elk Creek. Additionally, attached were the findings <br />of fact, conclusions oHaw and judgment of decree concerning the application for water rights <br />for the Town of New Castle, Colorado, and Eric C. Williams in Garfield County, Colorado. <br />This particular document is specifically what Mr. Bussone refers to as Case #83CW373. It <br />is important to note that, in that particular case, the first 1400 EaR for Castle Valley Ranch <br />will be augmented using the Coryell Ditch water rights which includes the senior water right <br />on ,East ,ElkCr.eek. In essence, the rate of exchange for the first 1400 units in the Castle <br />Valley Ranch development is 0.02 cfs for every 10 units placed on the Town of New Castle <br />water works system and pipeline. <br /> <br />Therefore, the 0.9 cfs discussed-as'a -limit-ed physical water supply to the Town of 'New <br />Castle from East Elk Creek in a low flow year is actually increased to 1.282 cfs when <br />considering the exchanged water rights from the Coryell Ditch with the Castle Valley <br />Development. This is based upon the consideration that 191 units have been constructed in <br />Castle Valley Ranch. <br /> <br />As the Castle Valley Ranch Subdivision continues to place units on the Town's water system, <br />an'-exchangecof water rights from a senior right on East Elk Creek will be transferred to the <br />Town. Thus, in the low flow year, theD.9 cfs is no longer applicable as the definite water <br />rights for theTown of New Castle. However, this water right increases in proportion to the <br />amount of units being developed in Castle Valley Rancb. It is important to note, however, <br />that as these water rights are being transferred totheTownofNew Castle, these water rights <br />can only be exclusively used for augmentation of the Castle Valley Ranch developnnmt. <br /> <br />Bearing the previous discussion in mind, this report focused upon tbe number of EaR's that <br />the Town's, existing Jegal and physical water right could support prior to the development of <br />Castle Valley Ranch. Further, irfocusesonthe TownLs-physical'andlegalwater-supplieswith <br />the inclusion of Castle Valley Ranch and, finally, it will focus upon the Town's ability to treat <br />the physical and legal water supplies. <br /> <br />l. POPULATION AND EQR CALCULATIONS <br /> <br />To properly define the supply and demand upon the Town's water system, it was necessary <br />to obtain information pertaining to the number of and type of units within the Town limits (or <br />on the Town's water system). You will find attached two sheets of information identified as <br />"Data/Information For Planning", prepared by Michael Blair, T-own of New Castle's Planner. <br />In this information, a land use breakdown prepared on November 30, 1994, was utilized to <br />develop a profile for EaR calculations also attached.
