<br />COLORADO ST ATE BOARD OF AGRICULTURE BY AND THROUGH COLORADO ST ATE UNtVERSITY
<br />
<br />WHEREAS, authority exists in the law and funds have been budgeted, appropriated and otherwise
<br />made available and a sufficient unencumbered balance thereof remains available for payment in Colorado
<br />Water Conservation Board, FUND NUMBER 424, AGENCY PDA, ORGANIZATION YYYY,
<br />APPROPRIATION CODE CSU, PROGRAM WTRC, OBJECT CODE 5140, GBL CIMl in the amount
<br />of$136, 131.00, CONTRACT ENCUMBRANCE NUMBER C150069; and
<br />
<br />WHEREAS, The Colorado State Board of Agriculture by and through Colorado State University
<br />for the benefit of the Colorado Institute for Irrigation Management (CTIM), a branch of the Colorado State
<br />University, is conducting a study entitled "Benefits and Costs of Pressurized Dual Water Systems In
<br />Colorado" ("Study") with a total projected cost of$220,512; and
<br />
<br />WHEREAS, the CTIM will manage this Study with sponsoring organizations, team members and
<br />endorsers consisting of the Northern Colorado Water Conservancy District, Tri-Districts, St. Vrain and
<br />Lefthand Water Conservancy District, J-U-B Engineering, Inc" Colorado State University, Weld County,
<br />New Cache La Poudre Irrigating Company, Highland Ditch Company; and
<br />
<br />WHEREAS, the Study is an assessment of the potential for pressurized raw irrigation water for
<br />landscape use in unincorporated and incorporated areas in Colorado, primarily concentrating on the
<br />Northern Colorado Front Range, and will be conducted in two parts: Part I will generate a regional level
<br />report on the potential for expanding pressurized dual system water service in northeastern Colorado and
<br />address broad opportunities and the constraints for dual system development including assessing the gap
<br />between regional water supply and demand and the extent dual systems can bridge that gap, at a total cost
<br />of$125,121. Part II will generate a case study report based on demonstration projects developed with the
<br />cooperation of two participating companies, the New Cache La Poudre Irrigating Company ad the
<br />Highland Ditch Company, at a total cost of$95,391; and
<br />
<br />WHEREAS, the CTIM applied for total funding from the Colorado Water Conservation Board
<br />(CWCB) in the amount of $136,131, applied $93,259 to Part I and $42,872 to Part II, and the CWCB
<br />approved the funding request at its January 2001 meeting.
<br />
<br />WHEREAS, S37-60-121(l)(b)(IV) C,RS, authorizes the CWCB to make grants from the CWCB
<br />Construction Fund with specific authorization from the General Assembly, and the Colorado General
<br />Assembly authorized the CWCB to provide funding to CTIM in the amount of $136,131 pursuant to
<br />Senate Bill 01-157, Section 6,
<br />
<br />NOW, THEREFORE, it is hereby agreed that:
<br />
<br />A, Scope of Services. The ClIM shall conduct the Study tasks in accordance with the Study Scope of
<br />Work, Schedule and Budget contained within the Assessment of the Benefits and Costs of
<br />Pressurized Dual Water Systems In Colorado, attached as Appendix A and incorporated herein.
<br />
<br />B. Time of Performance This agreement shall become effective upon the date this agreement is signed
<br />by the State Controller or designee and shall be in effect through August 1, 2003,
<br />
<br />C, Compensation and Method of Payment Total compensation responsibility by the CWCB under this
<br />MOU shall not exceed One Hundred Thirty Six Thousand One Hundred and Thirty One Dollars
