Un~t - - II, <br />WHEREAS, rel.juircd apPW'";l1, cle:lrOlllce and l'unrdination has been accomplished from and with appropriate <br />agencies: and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-119. <br />Colorado Revised Statutes, as amended, the State is authori2ed <br />to construct certain water projects for the benefit of the <br />people of the State of colorado; and <br /> <br />WHEREAS, the Ute Water Conservancy District has made <br />application to the State for the improvement of its existing <br />facility, such improvement of the facility is hereinafter <br />sometimes referred to as the project: and <br /> <br />WHEREAS, the Contractor is a water Conservancy District <br />within the State of colorado: <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />1. The Contractor shall have a feasibility report prepared <br />and directed to the problem of improving the Plateau Creek raw <br />water pipeline in accordance with a proposal for a proAect <br />feasibility report prepared by the conSUlting engineering firm <br />of Western Engineers, Inc. (the Consultant). and approved by <br />the State, dated December 19,.1986, which proposal is attached <br />hereto as Exhibit A and made a part o~-this .contract. <br /> <br />2. Fifteen (L5) copies of the final report called for in <br />this contract shall be furnished to the State not later than <br />August 1, 1987, unless such time is extended by mutual <br />agreement of the parties hereto in writing. <br /> <br />3. As compensation for the services of the contractor, the <br />State shall pay to the Contractor the sum of ,Sixty-Two Thousand <br />Five Hundred Dollars ($62,500) in the manner ,fOllowing: <br /> <br />a. Sixty percent (60\), to wit. Thirty-Seven Thousand Five <br />Hundred Dollars ($37,500) of the total amount due in two <br />(2) monthly installments of Eighteen Thousand Seven Hundred <br />Fifty Dollars ($18.750) each, commencing on April 15. 1987. <br /> <br />b. The remaining forty percent (40\), to wit, Twenty-Five <br />Thousand Dollars ($25,000) within forty (40) days fOllowing <br />receipt and acceptance of the written report specified in <br />paragraph 2. of this contract. <br /> <br />~~1 4.
