<br />WHEREAS. the Contractor is a duly f.ormed water conservancy
<br />district witnin tne State of Colorado; and
<br />
<br />WHERr.AS, pursuant to tne provisions of Section
<br />37-60-122(1)(c), C.R,S, (1990), tne State is autnorized to
<br />cause a feasibility report to be prepared on a proposed project
<br />if sucn project appears to qualify for consideration for
<br />funding by tne State under section 3".60-119, C.R.S. (1990), or
<br />to cause a feasibility report to be prepared on any other water
<br />project proposed in this state; and
<br />
<br />WHEREAS, tne Contractor earlier made application to tne
<br />State for funding for tne improvement of its existing facility,
<br />such improvement of. the facility being known as the "Plateau
<br />Creek Pipeline" (hereafter sometimes refer.red to as the
<br />project); an engineering firm. Western Engineers Inc. (WEl),
<br />prepared a feasibility study of tne project; and moneys were
<br />subsequently appropriated for the project based on such study
<br />by tne General Assembly pursuant to Senate Bill 30 in 1988; and
<br />
<br />WHEREAS, tne feasibility study, and appropriation, for tne
<br />project contemplated construction of a parallel pipeline; and
<br />it now appears tnat a tunnel in a diff.erent'location may better
<br />serve the Districtls needs than the pipeline as originally
<br />planned; and
<br />

<br />WHEREAS. a new feasibility study, referred to nereinafter
<br />as the Ilfeasibility study amendment.." is now required to be
<br />prepared. to weigh the costs and benefits of a tunnel against
<br />tnose of tne earlier-planned pipeline,
<br />
<br />NOW THEREFORE, it is nereby agreed tnat;
<br />
<br />1. Tne Contractor snatl nave a feasibility report prepared
<br />and directed to the problem of improving its facilities in
<br />accordance witn a proposal for a project feasibility study
<br />amendment prepared by tne conSUlting engineering firm of
<br />SRK-ROBINSON (tne Consultant) and approved by the State,
<br />received May 29.. 1990. which proposal is attached hereto as
<br />Appendix A and made a part of tnis contract.
<br />
<br />2, Five (5) copies of tne final report called for in tnis
<br />contract snall be furnisned to tne State not later tnan ninety
<br />(90) days after the date of this contract. unless such time is
<br />extended by mutual agreement of the parties hereto in writing.
<br />
<br />3. As compensation for the services of the Contractor. the
<br />State shall pay to the Contractor the sum of Thirteen Thousand
<br />Two Hundred Twenty,t'ive Dollars ($13,7.25) in tne manner
<br />following:
