<br />'to <br /> <br />. <br /> <br />s:4~ , <br /> <br />~ -/I~?! <br />"ECIWID <br />", 19 '89 <br /> <br />c"'..v,...."'v wATER <br />CON~!~VATrON <br />"" <br /> <br />. d <br /> <br />WEST DIVIDE <br /> <br />BY-LAWS <br />of the <br />WATER CONSERVANCY DISTRICT <br /> <br />PREAMBLE <br /> <br />The West Divide Water Conservancy District was organized <br />for the purposes of conserving and developing land and water <br />resources for the greatest beneficial use of water within the <br />District boundaries. The District was organized by decree of the <br />District Court, Ninth Judicial District, in and for Garfield <br />County, Colorado on April 10, 1964. The District has broad <br />statutory powers concerning the conservation and utilization of <br />water resources within its boundaries. <br /> <br />BY-LAWS <br /> <br />The following by-laws were adopted by the Board of <br />Directors on the 16th day of April, 1986, to govern the operation <br />and administration of the District. <br /> <br />ARTICLE I. <br /> <br />Section 1. Board of Directors - Organization. Members <br />of the Board of Directors shall be appointed by the Court or <br />chosen in the manner provided by "The Water Conservancy Act of <br />Colorado." The District is presently divided into five geographic <br />divisions with one Director representing each division. The Board <br />of Directors is the governing body, authorized to perform the <br />functions of the District. All Directors must have the <br />qualifications required by statute and the Decree of the Court <br />establishing the District. A vacancy in the Board of Directors <br />shall be filled in the manner required by law. A majority of the <br />Directors shall constitute a quorum for the transaction of <br />business. Each Director shall reside in and own real property in <br />the geographic boundaries of the division he represents. <br /> <br />Section 2. Board of Directors Duties and <br />Responsibili ties. It shall be the duty and responsibility of the <br />Board of Directors to act and be sure the actions of its staff <br />conform to federal, state, and local statutes and ordinancesl <br />execute legal documents, contracts, and obligations and operate in <br />conformance to its by-laws and rules and regulations; maintain <br />accurate minutes of Board meetings and publish accounts and <br />proceedings in accordance with state laws; establish policy, <br />appoint officers and outline the duties of each, in writing or as <br />deemed essential; pass upon reports of the Manager, Secretary, <br />Treasurer and other officers, employees, and staff of the <br />bistr ict; approve budgets; establ ish water assessments and <br />charges; audit all bills and accounts of the District; and <br />exercise general supervision of affairs of the District. <br /> <br />-1- <br />
