In March 1999, the CONTRACTOR requested a ono- <br />year extension of time to complete its purchases of the SHARES, stating that, while it <br />has worked diligently to obtain Amity Shares, Fort Bent Shares and the remaining <br />Highland. Sharep, the CONTRACTOR will not be able to complete those purchases by <br />May 28, 1999>/ <br /> <br />G. The STATE and the CONTRACTOR have agreed to amend this contract to extend the <br />time for cOll)pletion of the BORROWER'S purchase of the SHARES by one year, to May <br />28, 2000. v . . <br /> <br />NOW THEREFORE, the parties hereby agree that <br /> <br />1. Consideration, lor this Amendment to the ORIGINAL CONTRACT consists of the. <br />payments which shall be .made pursuant to this Amendment and the ORIGINAL CONTRACT <br />and the promises and agreements herein set forth. <br /> <br />2. The parties expressly agree that this Amendment is supplemental to the <br />ORIGINAL CONTRACT and all terms, conditions, and provisions thereof, unless specifically <br />modified herein, are to apply to this Amendment as though they were expressly rewritten, <br />incorporated, and included herein. <br /> <br />3. The 'parties agree that the ORIGINAL CONTRACT is and shall be modified, <br />altered, and changed in the following respects only: <br /> <br />a) The following paragraph shall be added as Factual Recital 10: <br /> <br />.; At its July 1998 meeting, the CWCB approved the BORROWER'S use of loan <br />funds under this contract to purchase Amity Shares at a price equivalent to <br />about $675 per acre-foot, or at a price approved by the CWCB Director, Dr <br />any combination of shares in the Amity Mutual Irrigation Company, the Fort <br />Bent Ditch Company, or the Highland Irrigation Company ("SHARES"), with <br />all SHARES purchased to be pledged as collateral for the loan. <br /> <br />b) The second sentence of Paragraph A.1 of the ORIGINAL CONTRACT shall be <br />amended to read as follows: "Therefore, the BORROWER shall complete its <br />purchase of the Shares no later than May 28, 2000." <br /> <br />c) The Special Provisions are amended by the addition of the following <br />paragraph: <br /> <br />11. Pursuant to CRS 24-30-202.4 (as am~ded), the state controller may <br />withhold debts owed to state agencies under the vendor offset intercept <br />system for: (a) unpaid child support debt or child support arrearages; (b) <br />unpaid balance of tax, accrued interest, .or other charges specified in <br />Article 22, Title 39, CRS; (c) unpaid loans due to the student loan division <br />of the department of higher education; (d) owed amounts required to be <br />paid to the unemployment compensation fund; and (e) other unpaid debts <br />owing to the state or any agency thereof, the amount of which is found to <br />be owing as a result of final agency determination or reduced to judgment <br />as certified by the controller. <br /> <br />4.
