Inc.. 588-24~ Road, Grand Junction, Colorado 81501, hereinafter referred to as the contractor, WHEREAS. authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 . G/L Account Number 52257 . Contract Encumbrance Number r.111'1169 ; and WHEREAS, required approval, c1e:lrance and coordination has been llccomplished from and with appropriate agencies: and WHEREAS, 'J pursuant to the provisions of 37-60-119, Colorado Revised statutes 1973, as amended, the colorado Water Conservation Board is authorized to construct certain water projects for the benefit of the people of the state of Colorado; and WHEREAS, the Upper Yampa Water Conservancy District has made application to the Colorado water Conservation Board for further planning of the Yamcolo Reservoir ~ulti-purpose project; and WHEREAS, the Contractor is a professional engineering firm within the State of Colorado, and has previously done considerable water- related'work for the Upper Yampa Water Conservancy District and various other municipalities and conservancy districts in Colorado; NOW THEREFORE, it is hereby agreed that 1. The Contractor agrees to perform exploratory drilling and establish movement monitoring points along the proposed Yamcolo damsite in accordance with a proposal prepared by the contractor and approved by the Colorado Water Conservation Board, dated June 29, 1977, which proposal is attached hereto as Exhibit A and made a part of this contract. The Contractor also agrees to prepare a report of the work executed as described above. 2. Ten (10) copies of the report called for in this contract shall be furnished to the State not later than November 30, 1977, unless such time is extended by mutual agreement of the parties hereto. 3. As compensation for the services of the Contractor, the state agrees to pay to the Contractor the sum of Five Thousand Dollars ($5,000) in the manner following: a. sixty percent (6~/o), to wit, Three Thousand Dollars ($3,000), of the. total amount due in two (2) equal monthly installments of One' Thousand Five Hundred Dollars ($1,500) each, . commencing on October 15, 1977. b, The remaining forty percent (40%), to wit, Two Thousand Dollars ($2,000) within thirty (30) days following receipt and acceptance of the written report specified in paragraph 2 of this. contract.
