_' Form 6-AC-02 '/'1::.. 7{' -1'/<( / 'DEPARTMENT OR AGENCY NUMBER 34-04-00 CONTRACT ROUT~~NUMBER 307.- CONTRACT $18,470 THIS CONTRACT, made this 1 s t day of October State of Colorado for the use and benefit of the Department of '1 Colorado Water Conservation Board hereinafter referred to as the State, and '2 McIntire & Quiros of Colorado, Inc. 570 West 44th Avenue, Denver, Colorado 80216 hereinafter referred to as the contractor, 197.2., by and between the Natural Resources, WHEREAS, authority exists in the Law and funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number ..J,..O-e:1:-, G/L Account Number 52077, Contract Encumbrance Numbere 10.302/; and ~(/O!J WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, 'J pursuant to the provisions of 37-60-119, Colorado Revised statutes 1973, as amended, the Colorado Water Conservation Board is authorized to construct certain water projects for the benefit of the people of the State of Colorado; and WHEREAS, the Town of Rangely has made an application to the Colorado Water Conservation Board for the construction of a water project for the purpose of improving its municipal water supplYi and WHEREAS, the contractbr is a professional engineering firm within the State of Colorado and has previously done considerable water-related work for the Town of Rangely and various other municipalities in Colorado; NOW THEREFORE, it is hereby agreed that 1. The contractor agrees to prepare a feasibility report directed to the problem of improving the municipal water of the Town of Rangely in accordance with a proposal for project feasi- bility report prepared by the contractor and approved by the Colorado Water Conservation Board, dated September 10, 1975, which proposal is attached hereto as Appendix A and made a part of this contract. 2. Thirty (30) copies of the report called for in this contract shall be furnished to the State not later than December 15, 1975, unless such time is extended by mutual agreement of the parties hereto. 3. As compensation for the services of the Contractor, the State agrees to pay the Contractor the sum of Eighteen Thousand Four Hundred Seventy Dollars ($18,470) in the manner following: a. sixty percent (60%), to wit, Eleven Thousand Eighty- Two Dollars ($11,082) of the total amount due in two (2) monthly installments of Five Thousand Five Hundred Forty-One Dollars ($5,541) each, commencing on November 15, 1975. b. The remaining forty percent (4~~), to wit, Seven Thousand Three Hundred Eighty-Eight Dollars ($7,388) within thirty (30) days following receipt and acceptance of the written report specified in paragraph 2 of this contract. 4. This contract is personal in nature and assignment of performance by the Contractor to another is prOhibited unless prior approval in writing is granted by the State.
