Phare <br />Director of Public Works <br />city of Louisville <br />749 Main street <br />Louisville, CO 80027 <br /> <br />Re: Raw Water Master Plan Contract between the City of <br />Louisville and the state of Colorado, Colorado Water <br />Conservation Board <br /> <br />Dear Mr. Phare: <br /> <br />You have requested our opinion on certain matters in relation to <br />the Raw Water Master Plan Contract (Contract) between the City of <br />Louisville and the state of Colorado, Colorado Water Conservation <br />Board, in the amount of $48,285. We reviewed a copy of the <br />Contract which you provided to us on September 27, 1991 and which <br />was attached to a letter to you dated September 23, 1991 from Frank <br />M. Akers, P.E., Chief, Project Planning and Construction section of <br />the Colorado Water Conservation Board. Based on our review of the <br />Contract and our knowledge of the actions of the city, and of the <br />laws applicable to it, it is our opinion that, under the facts as <br />we understand them to exist: <br /> <br />1. The signature of the person signing the Contract for the <br />city of Louisville, Colorado, is that of Herman Fauson, <br />the duly elected Mayor of the city of Louisville. <br /> <br />2. Herman Fauson, Mayor of the City of Louisville, has been <br />authorized by the City council of the City of Louisville <br />to sign the Contract on behalf of the City and the <br />Louisville City Council has approved the Contract. <br /> <br />3. The city Council of the City of Louisville has the <br />authority to enter into the contract without a vote of <br />its registered electors. <br /> <br />4. To the best of our knowledge, there are no provisions in <br />the City's ordinance or in other State or city law that <br />prevents this Contract 'from binding the city. <br />
