A recent
examination disclosed that the City has not furnished CWCB with a Warranty Deed as provided by Paragraph
A.14 of this agreement.

CWCB has determined that a Deed of Trust is sufficient to secure the loan as a security interest rather than
conveyance of title by Warranty Deed. Therefore, enclosed for your handling is a Deed of Trust to satisfy the
above referenced provision. Please execute this Deed of Trust with the applicable signatures being notarized
and return the document to CWCB. CWCB will record the document with the County of Mesa and will
provide a copy to you upon its receipt from the county. Referencing Paragraph I of this agreement, the Deed of
Trust will be released to the City upon final payment of the full purchase price of the loan.

Should you have any questions, please contact me at Telephone No. (303) 866-3441. Thank you for your
assistance in this matter.

,

(JJh~

I an, Contract Administrator
ction Fund Section

cc: Bassi, AGO
Serlet, CWCB
CWCB File

Flood Control and Floodplain Management.Larry Lang, Chief.
