<br />BACKGROUND

<br />In 1989 a geomembrane liner was installed on portions of the upstream face and left
<br />abutment area of the Continental dam to control seepage. The CWCB loaned $510,000 to
<br />the Company, $257,000 of which was used to complete'the Continental repair.
<br />When the reservoir was eventually filled in 1993, seepage again emerged on the
<br />downstream face and left abutment area of the dam in an amount and location similar to
<br />conditions which existed prior to the 1989 repair. As a result, and for the same safety
<br />reasons, the State Engineer's Office reimposed the storage restriction.
<br />The Company hired Harza, Consulting Engineers, to reevaluate the seepage
<br />condition. Harza has recommended additional feasibility study work at a cost of $48,500.00
